Accidental Landlord Ombudsman Registration: What Single-Property Owners Need to Know
One Property Is Enough
The most common misconception in landlord forums is that the new PRS Landlord Ombudsman scheme is aimed at large portfolio operators or professional landlords. It isn't. Section 64 of the Renters' Rights Act 2025 allows regulations to require residential landlords to join a scheme, with no portfolio-size threshold. The government expects mandatory sign-up in 2028, but the membership regulations have not yet been made.
This catches a lot of people off guard — particularly accidental landlords who inherited a property, couldn't sell and decided to let it, or moved in with a partner and rented out their flat. The expected future requirement has no portfolio-size threshold; the membership regulations have not yet been made.
Who Counts as an Accidental Landlord?
The term has no legal definition, but it describes the reality for a large segment of England's private landlord population. You might have:
- Inherited a property and let it rather than selling during a weak market
- Relocated for work and rented out your previous home
- Moved in with a partner and kept your flat as a rental
- Bought a property that turned out to be unsuitable and let it out temporarily
In every case, if you're granting an assured periodic tenancy or a regulated tenancy, you fall within the Act's landlord-redress scope. The exact membership requirements will be set by regulations.
What the Scheme Means for Small Landlords
The scheme framework requires members to be given time to resolve a complaint internally before the ombudsman accepts it. SI 2026/1033 does not set fixed acknowledgement or response deadlines; the approved scheme's rules will set them. Prompt, documented handling can resolve concerns before external escalation.
But if a complaint does escalate, the ombudsman can order:
- Binding compensation of up to £25,000
- Formal apologies and written explanations
- Mandatory corrective action — specific repairs, safety certification renewals, or policy changes
- Referral for enforcement if you refuse to comply, including expulsion from the scheme
Expulsion is particularly serious: the scheme may publish an expelled member's name and property details. If membership is required, continuing to let or market after expulsion can lead to enforcement. A Rent Repayment Order of up to two years' rent is available only for qualifying offences, including a continuing redress-scheme breach after a penalty.

Self-Managing vs Agent-Managed — the Duty Is Identical
Whether you manage the property yourself or pay a letting agent makes no difference to the future landlord membership duty. Agent redress schemes (TPO, Property Redress Scheme) cover agent conduct. The Landlord Ombudsman will cover a member landlord's conduct. These are separate obligations under separate Acts of Parliament.
If your agent handles day-to-day maintenance calls, you remain responsible for your own landlord duties. Once the scheme operates, a complaint within its scope may be made against the landlord; dated records can show how you and your agent handled the issue.
What to Prepare Before 2028
Mandatory membership is expected in 2028, following designation of a scheme administrator and enactment of membership regulations. No registration portal exists yet. But the ombudsman will evaluate your historical conduct, so records from 2026 and 2027 matter.
For a single-property landlord, the essentials are straightforward:
Keep a complaint log — even informal tenant messages about a dripping tap or a faulty boiler count. Record the date received, your response, the action taken, and the completion date.
Maintain safety certificates — current Gas Safety Record, EICR, EPC meeting minimum efficiency standards, and deposit protection confirmation. The PRS Database registration will include safety information where required; the government is exploring database-to-scheme information sharing, but the arrangements have not been announced.
Save all communications — emails, text messages, and letters. The ombudsman's evidence requirements centre on what you can demonstrate in writing.
Register on the PRS Database when your region opens (West Midlands from 15 December 2026, rolling out nationally through November 2027). This is a separate £65-per-property requirement. The government is exploring ways for the database and ombudsman to share information; the exact arrangements have not been announced.
The PRS Landlord Ombudsman guide includes a complete compliance system built for landlords with one or two properties — complaint log templates, tenant response letters, and a dated checklist covering both database and ombudsman registration.
