Accidental Landlord Southwark Licence: What New and Inherited Property Owners Need

When Letting Was Not the Plan

An accidental landlord is someone who ends up renting out a property they did not buy to let — an inherited flat, a home they could not sell, a property kept after relocating for work or a relationship. Southwark has a high concentration of these owners. The borough's mix of older housing stock and high property values means many residents inherit or retain properties and let them out rather than selling.

The licensing obligations are identical whether you planned to be a landlord or fell into it. There is no reduced requirement or statutory exemption for accidental landlords. Southwark says that when it identifies an unlicensed property, it issues a warning giving the landlord up to 21 days to apply; enforcement may still follow sooner if the property is unsafe or has serious housing-standard breaches.

Which Licence an Accidental Landlord Typically Needs

Most accidental landlords let to a single household — a family, a couple, or one individual. That means:

  • In one of the 19 selective licensing wards: a selective licence at £945 total
  • In one of the 4 exempt wards (Borough and Bankside, Dulwich Village, North Bermondsey, St George's): no local licence required

If you let to three or more unrelated sharers to help cover the mortgage, the property becomes an HMO and needs an additional HMO licence (£1,433) or a mandatory HMO licence (£1,653.50+ for five or more occupants). This catches landlords who let rooms individually or allow tenants to bring in flatmates.

The Managing Agent Question

Hiring a letting agent to find tenants or collect rent does not transfer the licensing obligation. Under the Housing Act 2004, the licence must be held by the person who receives the rack rent or has primary management control — which is usually the property owner. The agent can be named on the licence and can handle the application, but the legal liability stays with the owner.

Full-service managing agents in Southwark typically charge £300 to £600 plus VAT for licence application handling, or 13 to 15% of gross rent for full management. If your margins are tight on a single property, self-managing the application with a compliance guide is significantly cheaper.

Whether you use an agent or do it yourself, the same documents are needed — EICR, gas safety certificate, EPC, fire risk assessment (for HMOs), floor plans and tenancy agreement copies. The agent does not magically produce these; they coordinate the same certificates you would commission yourself.

Documents First, Then the Portal

The most common mistake for accidental landlords is starting the online application before gathering the documents. The portal has session timeouts, and incomplete drafts can be lost. You also cannot see the full list of required documents until you are mid-application, which leads to frantic searching for certificates while the session clock runs.

The essential document package:

  1. Electrical Installation Condition Report (EICR) — valid for 5 years, all C1/C2 defects cleared
  2. Gas safety certificate (CP12) — annual, current at application date
  3. Energy Performance Certificate (EPC) — minimum rating E, unless a valid exemption applies
  4. Fire risk assessment — suitable and sufficient for HMOs; Southwark directs landlords to LACORS fire-safety guidance
  5. Scale floor plans with room dimensions in m²
  6. Copy of the tenancy agreement
  7. Deposit protection confirmation

Penalties for Waiting

An unlicensed property in a ward that requires a licence is an ongoing offence from day one of the tenancy. The council can issue a civil penalty of up to £40,000 per offence, and tenants can apply for a rent repayment order covering up to 24 months of rent for offences committed on or after 1 May 2026.

Ignorance of the licensing requirement is not a defence. Neither is being an accidental landlord. The enforcement framework treats all landlords the same.
