Birmingham Landlord Licence for Single Lets: Do Small Landlords Need One?
One of the most common misconceptions about Birmingham's licensing schemes is that they only affect HMO landlords running shared houses. They do not. If you rent out a non-exempt single-family home in one of the 25 designated wards, you need a selective licence — even if it is your only property and even if you never intended to become a landlord in the first place.
Selective Licensing Applies to Single Lets
The selective licensing scheme exists precisely because the council wanted to bring single-let properties under regulatory oversight. Before the scheme, a landlord renting a two-bedroom house to a couple in Aston or Sparkhill had no proactive licensing obligation. HMO rules only kicked in at three or more occupants forming at least two households.
Since 5 June 2023, a privately rented property in the 25 designated wards needs a licence if it does not already require an HMO licence and no statutory exemption applies. That includes:
- A house let to a single-family tenant
- A flat let to a couple
- A property let to two unrelated tenants (two people, two households — below the HMO threshold)
The fee is £700 per property, split into a £375 application fee and a £325 grant fee.
Accidental Landlords Are Not Exempt
There is no exemption for accidental landlords — people who inherited a property, moved in with a partner and kept the old house, or ended up renting because they could not sell. The licensing requirement attaches to the property and its rental status, not to the landlord's intentions or portfolio size.
If the property is a non-exempt private rental in a designated ward and does not require an HMO licence, it needs a selective licence.
What About One-Property Landlords?
Same rule. Owning just one rental property does not reduce the fee, shorten the process, or grant any kind of exemption. The application process is identical whether you own one property or fifty. There are no portfolio discounts.
The council does offer fee reductions for landlords holding NRLA or MAPS accreditation — but the accreditation must be active at the time of application. This is the only discount mechanism available.

The Risk of Doing Nothing
"I only have one property" is not a defence. The penalties for operating without a licence apply regardless of portfolio size:
- Civil penalties up to £40,000
- Criminal prosecution with an unlimited fine
- Rent repayment orders allowing tenants to reclaim up to 24 months of rent
For a small landlord letting a single property at £650 per month, a rent repayment order alone could mean paying back up to £15,600 — far more than the cost of the licence.
How to Check If You Need One
First, verify whether your property is in one of the 25 designated wards using the council's address-level lookup tool (UPRN-based, not just postcode). Second, confirm the occupancy — if the property is let to a single household or one or two tenants, selective licensing applies in a designated ward unless a statutory exemption applies.
The Birmingham Landlord Licensing Guide covers the full process from ward verification through document assembly to the online application, with a compliance checklist designed for landlords managing the process themselves.
