Do I Need a Licence to Rent Out My House in Leicester?

You have heard that Leicester has a licensing scheme, and now you are wondering whether it actually applies to your property. The answer depends on three things: where the property sits, how many people live in it, and how those people are related.

The Two-Step Check

Leicester City Council runs two licensing regimes. First, mandatory HMO licensing applies city-wide to any house occupied by five or more people from two or more separate households who share a kitchen, bathroom or toilet. That applies regardless of which ward the property is in.

Second, selective licensing covers every other privately rented property — single-family lets, couples, single tenants and small shared houses with two to four occupants — but only within mapped parts of five specific wards: Braunstone Park & Rowley Fields, Fosse, Westcotes, Stoneygate and Saffron. The scheme has been in force since 10 October 2022 and runs until 9 October 2027.

If your property is outside the mapped selective licensing areas in those five wards and houses fewer than five people, you do not currently need a local property licence.

How to Confirm Your Property's Status

Postcodes are not reliable for boundary checks. The selective licensing boundary splits individual streets — one side of the road can be inside the zone while the other is outside. The only authoritative check is through Leicester City Council's Aurora mapping tool, which lets you search your exact address against the designation boundary.

Here is a quick decision sequence:

  1. Count the occupants. Five or more people from two or more households sharing amenities? You need a mandatory HMO licence. Full stop, anywhere in Leicester.
  2. Fewer than five occupants? Check whether the property address falls inside the selective licensing boundary using the Aurora map.
  3. Inside the boundary? You need a selective licence, whether the property is a single-family let or a small shared house.
  4. Outside the boundary and under five occupants? No local licence required, though national management regulations and housing standards still apply.

What About Small Shared Houses?

This is where many landlords trip up. Leicester does not operate an additional HMO licensing scheme. A house with three or four tenants from different households is technically a small HMO, but in Leicester it falls under selective licensing if it is inside a mapped licensing area. Outside those areas, it needs no licence (assuming fewer than five occupants).

The distinction matters because the fees and application routes differ. A selective licence costs £1,290 in total (£1,032 Stage 1 plus £258 Stage 2). A mandatory HMO licence costs a flat £900.

Exemptions

Not every rented property in the zone needs a licence. Statutory exemptions include properties managed by registered social landlords or public bodies, student accommodation controlled directly by a university (not private student lets — those are fully licensable), buildings occupied solely by the owner's family, resident landlords with no more than two lodgers, and long leases over 21 years. You can also apply for a Temporary Exemption Notice for up to three months if you are actively removing the property from the rental market.

The burden of proof sits with you. If you believe an exemption applies, you need documentary evidence to satisfy the council.

What Happens If You Get It Wrong?

Renting without a licence where one is required is a criminal offence. Leicester City Council can prosecute (unlimited fine in the magistrates' court) or issue a civil penalty of up to £40,000 for an offence committed on or after 1 May 2026; the previous maximum was £30,000. For an offence committed on or after 1 May 2026, a tenant or the local housing authority may apply for a rent repayment order covering up to 24 months of rent.
