Enfield Article 4 Direction: HMO Planning Permission Explained
One of the most common compliance mistakes in Enfield is assuming that an HMO licence is all you need to let a property to sharers. It is not. Since October 2013, Enfield has had a borough-wide Article 4 Direction that removes permitted development rights for converting a single-family home into a small HMO. A landlord who lets a C3 dwelling to three or more unrelated people without planning permission commits a planning offence — completely separate from any licensing breach.
What the Article 4 Direction Does
Under the normal planning rules, a householder can convert a single-family dwelling (Use Class C3) to a small HMO occupied by three to six people (Use Class C4) without needing planning permission. This is a "permitted development" right.
Enfield's Article 4 Direction, enacted on 22 October 2012 and effective from 22 October 2013, strips that right across the entire borough. Any conversion from C3 to C4 in Enfield requires express planning permission — a formal application to the planning department, separate from the Housing Act licensing process.
Who This Affects
If your property was originally let to a single family (C3 use) and you are now letting it to three or four unrelated sharers (C4 use), you need:
- An additional HMO licence under the Housing Act 2004 (borough-wide scheme, £1,450)
- Express planning permission for the change of use from C3 to C4
Getting the licence without the planning permission does not protect you. The council issues property licences under housing legislation and planning enforcement under planning legislation — they are independent systems. An HMO licence holder who lacks planning permission can face a Planning Enforcement Notice under Section 172 of the Town and Country Planning Act 1990 on top of any housing enforcement action.
When Planning Permission Is Not Needed
The Article 4 Direction only affects conversions from C3 to C4. If the property:
- Has always been used as a shared house (established C4 use predating October 2013)
- Already holds a lawful development certificate confirming C4 status
- Is a large HMO with seven or more occupants (Use Class Sui Generis, which always requires planning permission regardless of Article 4)
...then the Article 4 Direction does not change anything for that property. The key is whether the current use as an HMO is lawfully established.

How to Check Your Property's Planning Status
Contact Enfield Council's planning department and ask whether the property has an established C4 use class or whether planning permission is needed. You can also apply for a lawful development certificate for existing use, which provides formal confirmation if the property has been continuously used as an HMO for at least 10 years without enforcement action.
The property licensing team and the planning team are separate departments. Information shared during your licence application is not automatically checked against planning records, but cross-referencing does happen — particularly when inspections are carried out.
The Risk of Ignoring This
Operating an HMO without the required planning permission is an offence regardless of licensing status. The council can serve a Planning Enforcement Notice requiring you to stop using the property as an HMO and revert to single-family use. Non-compliance with an enforcement notice is itself a criminal offence.
Landlords who discovered the planning requirement after already converting sometimes apply retrospectively. Retrospective planning applications are allowed but not guaranteed — if the council refuses, the enforcement route is the same.
