Gateshead Licence Conditions: What You Must Do After Getting Your Licence

Getting the licence is not the finish line. Every Gateshead property licence comes with a set of conditions that run for the full five-year term, and breaching them is a separate offence that can result in a civil penalty of up to £40,000 — on top of whatever the original licence cost you.

Here is what the conditions actually require.

The 12 Standard Condition Categories

Gateshead's licence conditions span 12 operational areas, enforceable under Section 90 (selective) and Section 67 (HMO) of the Housing Act 2004:

  1. Gas safety
  2. Electrical safety
  3. Smoke alarms
  4. Carbon monoxide alarms
  5. Furniture safety
  6. Tenancy agreement terms
  7. Tenant referencing
  8. Tenancy management
  9. Anti-social behaviour management
  10. Property maintenance
  11. Household waste management
  12. Notification of material changes

Most of these translate into specific recurring tasks that you need to manage throughout the licence term.

Key Ongoing Requirements

Annual Gas Safety

You must obtain a new CP12 every 12 months from a Gas Safe registered engineer. A copy goes to your tenants within 28 days of each inspection, and you must supply a copy to the council on demand within 7 days. Letting the certificate lapse — even by a week — is a licence condition breach.

Smoke and Carbon Monoxide Alarms

Working smoke alarms on every storey. CO alarms in any room with a fixed combustion appliance. You are responsible for testing them at the start of each tenancy and maintaining written test logs. A missing alarm during a council inspection is an immediate compliance failure.

Property Inspections

Licence holders must conduct physical management inspections at minimum intervals of six months. These are your own inspections — walk-throughs to check structural condition, maintenance issues, and tenancy compliance. Keep written records: date, findings, any follow-up actions.

Anti-Social Behaviour Protocols

You must take proactive steps to prevent or suppress ASB by tenants or their visitors. That means issuing formal written warnings when problems arise, keeping written records of all complaints and investigations, and cooperating with council officers and police. Ignoring persistent neighbour complaints puts your licence at risk.

Tenant Referencing

Pre-tenancy referencing is mandatory for all new occupants. You must check suitability before executing a tenancy agreement — not after. The specific checks are at your discretion (identity, right to rent, previous landlord reference, credit check), but you must demonstrate that referencing was done.

Documents on Demand

If the council requests compliance documentation — gas certificates, EICRs, tenancy agreements, inspection records — you must deliver them within 7 days. The request can come at any point during the licence term, not just during a formal inspection.

Waste Management

Provide adequate refuse storage. Keep the property, yard, garden and boundaries clean and free from fly-tipping. This is one of the most common trigger points for council attention — a property with rubbish piled in the front garden attracts complaints that lead to inspections.

What Happens When You Breach a Condition

The council can issue a civil penalty for a condition breach, vary the licence with additional restrictions, or in serious cases revoke the licence entirely. Revocation puts you back to square one — operating without a licence, exposed to the full penalty regime.

Tracking Conditions Over Five Years

The practical challenge is not understanding the conditions — it is maintaining compliance consistently over a five-year term. A CP12 renewal that slips, an alarm battery that dies between inspections, or an ASB complaint that goes unrecorded can each trigger enforcement.

The Gateshead Landlord Licensing Guide includes printable condition trackers and a maintenance calendar that converts each licence condition into specific tasks with deadlines, so nothing falls through the cracks over the full term.
