Hounslow Fit and Proper Person Test for Landlords
Every HMO licence application in Hounslow includes a fit and proper person check under section 66 of the Housing Act 2004. It applies to both the proposed licence holder and the named property manager, and failing it means the council can refuse the licence outright — regardless of how good the property is.
What the Council Checks
The fit and proper assessment looks at whether the proposed licence holder or property manager has:
- Criminal convictions involving fraud, dishonesty, violence, drugs or sexual offences
- Outstanding housing law breaches or current enforcement actions (improvement notices, prohibition orders, penalty notices)
- Unlawful discrimination findings under equality legislation
- A history of operating unlicensed HMOs or breaching licence conditions in any local authority area, not just Hounslow
The check extends to business associates. If the council has evidence that the applicant is acting as a front for someone who would fail the test — for example, an individual with convictions who has their partner apply instead — it can refuse the application on that basis.
How Declarations Work in the Application
During the online portal application, every individual involved in managing the property must complete a fit and proper person declaration. This is a formal statement disclosing any matters that fall within the assessment criteria.
Non-disclosure is treated seriously. If the council later discovers undisclosed convictions or breaches, it can revoke an already-granted licence and pursue enforcement action. The declaration is a legal statement, not a formality.
Spent Convictions
Hounslow's fit-and-proper assessment includes convictions involving fraud, dishonesty, violence, drugs or sexual offences. The sources for this article do not establish how the council treats spent convictions, so check the current application wording and Hounslow's licensing policy before deciding what must be disclosed.

Overseas Landlords
Hounslow applies a specific rule for overseas landlords who do not reside in the UK: the council will not issue a licence to an overseas individual or corporate body unless they execute a signed legal undertaking with a UK-resident manager or UK-registered letting agency. That manager or agency accepts joint legal accountability for ensuring full compliance with licence conditions.
This means an overseas landlord cannot simply apply remotely and manage the property from abroad without a UK-based responsible person named on the licence. The UK manager must also pass the fit and proper check.
What Happens If You Fail
If the council determines that the proposed licence holder or manager is not a fit and proper person, it must refuse the licence. The refusal notice sets out the reasons and the applicant has 28 days to appeal to the First-tier Tribunal (Property Chamber).
If the proposed licence holder or manager may fail the test, ask Hounslow Council before submitting whether another person can be named. The council assesses both the proposed licence holder and the named manager, and the licence holder remains legally responsible for compliance.
The licence fee is not refundable if the application is refused on fit and proper grounds.
Preparing for the Check
The most practical step is honesty and completeness in the declarations. Gather the details of any matters that might be relevant — conviction dates, case references, the name of the local authority for any housing enforcement history — before starting the application. Having this information ready prevents delays in the declaration section of the portal.
