Housing and Property Chamber Scotland: What Landlords Need to Know

The Housing and Property Chamber is the division of Scotland's First-tier Tribunal that handles eviction applications, rent disputes, and repairing standard cases for private residential tenancies. If a tenant doesn't leave after a notice to leave expires, this is where you go — not the Sheriff Court, not a solicitor's office, and certainly not the front door with a locksmith.

What Cases It Handles

For landlords, the main case types are:

  • Eviction applications under the Private Housing (Tenancies) (Scotland) Act 2016 — Form E, Rule 109
  • Eviction applications relying on conduct grounds — antisocial behaviour, property damage
  • Wrongful Termination Order applications from former tenants who believe they were misled into leaving

The tribunal also handles tenant applications — repairing standard enforcement and rent disputes, for example — and tenants can contest eviction applications, so you may encounter it from both sides.

How Applications Work

You submit Form E with your evidence package. There's no application fee. The tribunal validates your submission, registers the case, and serves notice on the tenant.

The evidence package for an eviction application includes:

  • The PRT agreement
  • The served notice to leave
  • Proof of service
  • Documentary evidence for each ground cited
  • Pre-action requirements records (for Ground 12)
  • Proof of Section 11 council notification

Case Management Discussion

The first hearing is usually a Case Management Discussion (CMD) — a preliminary session by phone or video conference. The tribunal member reviews the case, hears from both parties, and decides whether the matter can be resolved without a full hearing.

If the tenant doesn't contest the facts and the tribunal is satisfied on reasonableness, an eviction order can be issued at the CMD. This happens more often than you might expect — many tenants don't engage with the process or have already left by the time the CMD is scheduled.

Full Evidential Hearing

When facts or reasonableness are disputed, the case moves to a full hearing. This involves:

  • Oral evidence from both parties
  • Witness testimony
  • Cross-examination
  • Documentary evidence review

The tribunal member makes findings of fact, applies the reasonableness test, and issues a written decision.

The Discretionary Standard

Since the 2022 Act made all eviction grounds discretionary, the tribunal always asks: is eviction reasonable in the circumstances? Proving your ground (the factual test) is necessary but not sufficient.

The tribunal weighs:

  • The strength of your evidence
  • The tenant's personal circumstances (health, family, finances, vulnerability)
  • Whether the tenant has school-age children
  • The availability of alternative housing
  • Whether the landlord has complied with all statutory obligations

Well-prepared applications with strong documentary evidence have an easier path through the reasonableness test.

Timelines

Current processing times average 8 to 12 months from application to hearing. The variability depends on tribunal workload, case complexity, and whether the tenant contests.

After an eviction order, a 30-day appeal window applies. If no appeal is lodged, you obtain an extract order and instruct Sheriff Officers for enforcement.

Representation

You don't need a solicitor to apply or attend. Many landlords represent themselves. But if the case is complex — contested facts, human rights arguments, multiple grounds with mixed evidence — professional representation can make a difference.

The tribunal's procedures are less formal than a court, but the legal standards (especially on evidence and reasonableness) are rigorous.

The Notice to Leave in Scotland guide walks through the full tribunal application process, from filling in Form E to preparing for the CMD and building your evidence bundle.
