How to Apply for a Barnet HMO Licence Without Losing the £365 Non-Refundable Fee

The Problem: £365 Lost on One Missing Document

When you submit an HMO licence application to the London Borough of Barnet, the Stage 1 fee is £1,061. If an incomplete application is rejected, Barnet retains £365 as a non-refundable administrative charge. You still need to reapply and pay the Stage 1 fee for the new application.

This fee applies to mandatory and additional HMO applications. Barnet's proposed selective licensing scheme is not in force. The only way to avoid losing the £365 on an incomplete HMO application is to submit a complete, correctly formatted application the first time.

Why Applications Get Rejected

Barnet's most common rejection reasons, based on council guidance and landlord forum reports, fall into a handful of categories:

Expired safety certificates. Barnet requires a current Gas Safety Certificate (CP12), dated within the previous 12 months, when you submit the Stage 1 application. An EICR must be within five years of inspection, and the EPC must be valid within its ten-year lifespan. Check each certificate on the application date; one gathered months earlier may no longer be current.

Floor plans without room dimensions. Barnet requires scaled floor plans with accurate room dimensions, room uses and layout. A sketch without measurements will not meet the stated requirement. A floor plan that omits a room may create a discrepancy with the occupancy declaration.

Missing fire safety documentation. Barnet requires a current fire alarm test certificate, dated within the previous 12 months. Where emergency lighting is fitted or required, include a current emergency lighting certificate as well. Check the requirements against the property's layout and Barnet's HMO standards.

Incomplete fit-and-proper declarations. If a letting agent manages the property, the application must include their details and a management declaration. A landlord who leaves the management section blank or provides only the agent's company name without the individual licence holder's details will have the application returned.

Unresolved planning issues. Barnet's borough-wide Article 4 Direction, effective since 29 May 2016, means a dwelling converted to shared occupation (C3 to C4) after that date needs planning permission. If the conversion happened without permission, you may face planning enforcement or receive a shortened one-year licence; a licence does not resolve the planning position. Check whether planning permission or a Lawful Development Certificate is needed to regularize the use.

The Offline Preparation Method

The principle is straightforward: prepare every element of the application away from the council portal, verify each one against a checklist, and treat the portal session as a data-entry exercise rather than a research project. Barnet's web portal can time out if documents are not formatted and ready for immediate upload.

Step 1: Classify the Property

Determine which licence type applies before you touch any application form. Count your occupants. Identify households (a couple is one household; an unrelated sharer is a separate household). Check whether your property meets the mandatory HMO threshold (five or more occupants from two or more households) or the additional HMO threshold (three or four occupants from two or more households — Barnet's borough-wide scheme). If the property is in one of the ten proposed selective licensing wards (including Burnt Oak, Colindale North and Colindale South), check whether selective licensing has been designated yet.

Getting the scheme wrong means applying for the wrong licence, which the council will reject.

Step 2: Audit Every Document

Build a table with every required document, its status and its expiry date:

  • Gas Safety Certificate (CP12) — must be current on the application date
  • Electrical Installation Condition Report (EICR) — valid for five years
  • Energy Performance Certificate (EPC) — valid for ten years, minimum rating E
  • Fire alarm certificate — where required by property layout
  • Emergency lighting certificate — where required
  • PAT testing records — for any landlord-supplied portable appliances
  • Scaled floor plans — accurate room dimensions, room uses and layout

For each document, verify: is it current? Is it in a file format the portal accepts? Does it show the correct property address? Are the room dimensions clearly labelled? If any document is missing or expired, arrange the inspection or renewal before you proceed. Do not start the application with a gap you plan to fill later — the portal does not wait.

Step 3: Calculate Your Fees

Know the exact amount before you enter the portal:

  • New additional or mandatory HMO licence: £1,061 (Stage 1) + £811 (Stage 2) = £1,872
  • Renewal: £866 (Stage 1) + £811 (Stage 2) = £1,677
  • Accreditation discount: 10% off Stage 1 if you hold a London Landlord Accreditation Scheme certificate (saves £106.10 on a new application)

If you have eligible accreditation, make sure it is active and claim the discount in the initial portal submission; Barnet does not accept retroactive discount claims.

Step 4: Complete the Fit-and-Proper Declaration

Prepare your answers to the council's fit-and-proper questions:

  • Any unspent criminal convictions (including cautions)
  • Any housing-related civil penalties, banning orders, or management orders
  • Any association with a person who has been refused an HMO licence
  • If using a letting agent: the agent's name, registration number, and the individual who will be the licence holder or manager

Write these out in advance. The portal expects specific answers, not vague descriptions.

Step 5: Check the Article 4 Position

Verify whether your property was converted from a single dwelling (C3) to shared occupation (C4) after 29 May 2016. If it was, check whether planning permission was granted. If not, you may need planning permission or a Lawful Development Certificate to regularize the planning position. This is separate from licensing: an unresolved Article 4 issue can lead to planning enforcement or a shorter one-year licence. The guide walks through how to check this using the Barnet planning search.

Step 6: Submit in One Session

With every document uploaded, every field pre-answered, and the exact fee ready, the portal session should take 20–30 minutes. You are copying from completed worksheets, not figuring anything out live.

Frequently Asked Questions

Can I get the £365 back if the rejection was the council's error?

If you believe the council made a procedural error, contact Barnet through its complaints process and ask it to review the fee decision. The published refund policy covers specified circumstances, so do not assume a refund is automatic. Prevention is the most reliable way to avoid the charge.

How long does Barnet take to process an HMO application?

Barnet targets processing valid applications within 12 weeks of receipt. An application is treated as duly made only when the form is complete, mandatory documents are verified, and the Stage 1 payment has cleared. An incomplete application rejected as invalid must be corrected and resubmitted; submitting a complete application the first time avoids the additional delay.

Does the £365 apply to renewal applications too?

Yes. Renewal applications use the same two-stage fee structure (£866 Stage 1 + £811 Stage 2), and the administrative portion is non-refundable on rejection. Renewal applications are rejected for the same reasons as new ones: expired certificates, missing floor plans, or incomplete declarations.

What if my EICR expires while the application is being processed?

Barnet's published application requirements call for an EICR dated within five years at submission. If it expires while the application is pending, ask the council whether it needs an updated report.
