How to Handle Scotland PRT Setup Paperwork Without Paying a Letting Agent

Setting up a private residential tenancy in Scotland without a letting agent is straightforward if you follow the statutory sequence in the right order. The paperwork itself is not complicated — the risk is in the matching rules, the deadlines, and the proof of delivery. Miss the notes-matching rule and the First-tier Tribunal can award your tenant up to three months' rent. Skip the deposit deadline and the award jumps to one to three times the deposit value. A letting agent charges £300–£600+ VAT to handle this. You can do it yourself for a fraction of that cost if you know the sequence.

The Setup Sequence

Every PRT setup in Scotland follows the same five phases. An agent would do these in order; as a self-managing landlord, you do the same.

Phase 1: Landlord Registration

You must be registered on the Scottish Landlord Register before you let a property. The fee is £85 per local authority area plus £20 per additional property. If you register across multiple councils online at the same time, subsequent principal fees drop to £42.50. A late application fee of £170 applies if you let without registering or miss your three-year renewal.

Operating an unregistered tenancy is a criminal offence with fines up to £50,000. Your property advertisements must display your registration number or the phrase "landlord registration pending" alongside the EPC rating and the exact rent.

Phase 2: Safety Certificates

Before handing over keys, the property must satisfy the Repairing Standard under the Housing (Scotland) Act 2006:

  • EICR — Electrical Installation Condition Report, renewed every 5 years
  • Gas Safety Certificate (CP12) — renewed annually by a Gas Safe registered engineer
  • Interlinked alarms — smoke alarms in the living room and hallway, heat alarm in the kitchen, CO detector near fuel-burning appliances, all interconnected
  • EPC — Energy Performance Certificate
  • Legionella risk assessment — documented assessment of water stagnation and temperature controls

Since October 2026, Awaab's Law adds damp and mould deadlines: 10 working days to investigate after a report, 3 working days to provide a written summary, and 5 working days to start repairs.

Phase 3: Choose Your Agreement Format

This is where agents earn their fee — and where self-managing landlords most often go wrong.

You have two routes:

Route A — Model PRT. Use the Scottish Government's Model Private Residential Tenancy Agreement, either through the mygov.scot creation tool or the downloadable PDF from gov.scot. If you choose this route, you must serve the Easy Read Notes (ISBN 9781836011217). Not the Statutory Terms Supporting Notes. The Easy Read Notes.

Route B — Bespoke agreement. Use a solicitor-drafted or custom tenancy agreement. If you choose this route, you must serve the Private Residential Tenancy Statutory Terms Supporting Notes. Not the Easy Read Notes. The Statutory Terms Supporting Notes.

Serving the wrong set of notes is treated as a failure to provide notes at all. If you do not supply the missing terms or correct notes within 28 days after the tenant's written notice, the tenant can apply to the Tribunal. The Tribunal may award up to three months' rent for either omission, or up to six months if both written terms and notes were missing.

The Model PRT includes all nine mandatory statutory terms in bold text and a selection of basic discretionary terms. It does not include practical clauses for garden maintenance, parking allocations, utility account transfers, or structured check-in inventories. If you need those, add them under Clause 37 (Additional Terms) — keeping them lawful requires that they do not conflict with the mandatory terms.

Phase 4: Deliver the Documents

The written tenancy terms and matching statutory notes must be delivered on or before the tenancy start date. Required safety records and alarms must be in place before occupancy. Keep copies and a dated record of what you provide to the tenant:

  • The signed tenancy agreement
  • The correct statutory notes (Easy Read or Statutory Terms Supporting, depending on your agreement route)
  • Copies of the EPC, EICR, Gas Safety certificate
  • Interlinked alarm confirmation

Electronic delivery (email, portal) of statutory tenancy documents is allowed only if the tenant has explicitly agreed in writing before service to receive them electronically. Emailing a PDF without this prior consent does not satisfy the statutory delivery requirement.

Proof of delivery matters. The mygov.scot tool produces the agreement but gives you no delivery receipt. In a Tribunal dispute, the burden of proof rests entirely on you. A dated delivery log with tenant sign-off can help show when and what you provided; a sign-off is one way to record receipt.

Phase 5: Deposit Lodging

Within 30 working days of the tenancy start date, lodge the full deposit in a government-approved custodial scheme. Scotland uses custodial schemes only (insured schemes are prohibited). The three approved schemes are SafeDeposits Scotland, mydeposits Scotland, and Letting Protection Service Scotland.

The maximum deposit is two months' rent. You must also provide the tenant with written prescribed information — the amount received, the date lodged, the scheme's name and contact details, and the grounds for potential deductions.

Failure to lodge or to provide the prescribed information allows the tenant to apply to the Tribunal. The Tribunal must award compensation of between one and three times the deposit value.

What a Letting Agent Does That You Are Replacing

A tenant-find service at £300–£600+ VAT covers:

  • Tenant sourcing and advertising
  • Referencing and right-to-rent checks (though right to rent does not apply in Scotland)
  • Agreement preparation and signing
  • Document delivery and filing
  • Deposit lodging and scheme registration
  • Inventory preparation

Of these, tenant sourcing and referencing are the only parts that genuinely require third-party infrastructure (property portals, credit reference agencies). The agreement preparation, document delivery, and deposit lodging are administrative tasks with clear statutory steps. You are replacing the agent's administrative compliance work, not their market access.

The Tools You Need

For the agreement: The mygov.scot tenancy creation tool (free, generates Model PRT + Easy Read Notes) or a solicitor-drafted template.

For delivery proof and compliance tracking: A compliance guide like Private Residential Tenancies in Scotland: A Landlord's Guide to Setting Up a Tenancy gives you the notes-matching decision matrix, a Tenant Document Delivery Log, Clause 37 discretionary term add-ons, the pet request processing log for the Section 64A framework, and seven standalone printable worksheets covering every stage of the setup.

For deposit lodging: Register directly with one of the three approved custodial schemes. Each has an online portal. The process takes about 15 minutes.

The Mistakes That Cost Money

Wrong notes. Serving Easy Read Notes with a bespoke agreement, or Statutory Terms Supporting Notes with the Model PRT. If the omission is not remedied after the statutory notice, the Tribunal may award up to three months' rent.

Late deposit lodging. Missing the 30-working-day window. Penalty: one to three times the deposit value. This one is non-discretionary — if the Tribunal finds a breach, it must award compensation.

No delivery proof. Handing documents to the tenant on move-in day without a signed receipt. Not a penalty in itself, but without a record it may be harder to show what you delivered and when.

English-format agreement. Using an Assured Shorthold Tenancy template from an English legal site or Etsy seller. ASTs were abolished for new lettings in Scotland on 1 December 2017. A tenancy's legal status follows the statutory criteria, not the agreement's label, so use written terms and matching notes that meet Scotland's PRT rules.

Blanket pet ban. Since the Housing (Scotland) Act 2025, blanket bans on pets are prohibited. If a tenant submits a written pet request, you must respond in writing within 30 days with consent, conditions, or a reasoned refusal. The tenant can appeal to the Tribunal within 42 days of your response.

Who This Is For

  • Self-managing landlords in Scotland who want to handle the tenancy setup themselves instead of paying an agent
  • First-time landlords setting up their first PRT and unsure what documents to prepare and in what order
  • Accidental landlords who inherited a property or need to let a former home and want a clear compliance sequence
  • Landlords switching from a letting agent to self-management who need to run the next tenancy changeover independently

Who This Is NOT For

  • Landlords who prefer to delegate the entire setup — hire an agent and pay the fee
  • Landlords in England or Wales — England's Renters' Rights Act 2025 and Wales's occupation-contract system under the Renting Homes (Wales) Act 2016 are separate from Scotland's PRT regime
  • Anyone facing an active Tribunal claim or eviction — that requires a solicitor or advice from Shelter Scotland

Frequently Asked Questions

How much does a letting agent charge for tenancy setup in Scotland?

A typical tenant-find service from a high-street letting agent costs £300–£600+ VAT as a one-off fee. This covers tenant sourcing, agreement preparation, deposit lodging, and document delivery. Fully managed services with ongoing rent collection and maintenance coordination charge 8–15% of monthly rent.

Can I use the free mygov.scot tool for the agreement and handle the rest myself?

Yes. The mygov.scot tool generates a lawful Model PRT agreement with the correct Easy Read Notes. You still need to handle delivery proof, deposit lodging within 30 working days, safety certificates, and the October 2026 statutory updates (Awaab's Law, pet request framework, reduced succession threshold) yourself.

What is the notes-matching rule?

It is the strict legal alignment between your agreement format and the statutory notes you serve. Model PRT requires Easy Read Notes. Bespoke agreements require Statutory Terms Supporting Notes. Serving the wrong pair counts as failing to provide the notes, and the tenant can seek a Tribunal award of up to three months' rent.

Do I need to register as a landlord before setting up the tenancy?

Yes. Landlord registration is a statutory prerequisite. You cannot lawfully let a property in Scotland without an active registration or a valid pending application. The fee is £85 per council area plus £20 per property, and the penalty for operating unregistered is fines up to £50,000.
