Overseas Landlord HMO Licence in Islington: UK Agent Requirement and Application Rules
You own a rental property in Islington but live in Dubai, Singapore, Hong Kong or anywhere else outside the United Kingdom. The property needs a licence. Can you apply yourself? In most cases, no — not without a UK-based managing agent standing beside you on the application.
The UK Agent Requirement
Islington Council will not issue a property licence directly to an individual or company located outside the United Kingdom unless a UK-based managing agent is appointed as the proposed licence holder or as a co-declarant on the application. This applies to all licence types — mandatory HMO, additional HMO, selective and Section 257.
The requirement exists because the licence holder must be someone the council can contact, inspect with, serve notices on and hold accountable within UK jurisdiction. An overseas owner without a UK agent creates an enforcement gap — the council has no practical mechanism to compel compliance from someone outside the country.
Who Can Act as the UK Agent?
Islington requires a UK-based managing agent but the eligible types of agent are not specified here. Confirm with the council before relying on a family member or another non-professional contact to act in that role.
The proposed licence holder and property manager are subject to the fit-and-proper person assessment. Previous housing offences, civil penalties and enforcement history are relevant; confirm the proposed agent's eligibility with the council.
What the Agent Signs
The UK agent must sign formal statutory declarations accepting full legal responsibility for scheme compliance. The agent may be named as proposed licence holder or co-declarant; confirm which role applies, since being named as a co-declarant does not itself make the agent the licence holder.

Cost Implications
Professional agents typically charge for acting as a licence holder. This is separate from any standard property management fee and reflects the legal liability the agent assumes. Fees vary — some agents bundle it into their management package, others charge a standalone annual fee for the licence-holding role.
The licence application fee itself remains the same whether the applicant is UK-based or overseas. The £850 selective licence fee or £900-plus HMO fee is payable by whoever submits the application through the council's online portal.
What If You Move Abroad After the Licence Is Granted?
Before relying on an existing licence after moving abroad or changing contact or managing-agent details, ask the council whether a variation or notification is required. Changes to managing-agent details or contact addresses are matters for a licence variation.
Alternative: Appointing a UK-Resident Individual
Some overseas landlords may consider a UK-resident family member, but confirm with the council that the specific person is accepted as a managing agent or licence holder and understand the obligations attached to that role before applying.
Our Islington Landlord Licensing Guide covers the licence holder eligibility rules, the UK agent requirement, and the fit-and-proper test criteria — everything an overseas landlord needs to set up the right structure before starting the application.
