Landlord Ombudsman Start Date 2028: When Do Landlords Have to Join in England?

No Registration Portal Exists Yet

If you own a rental property in England and you've been searching for a sign-up page for the new Landlord Ombudsman, you won't find one. Mandatory membership in the PRS Landlord Ombudsman scheme has not started. No scheme administrator has been appointed, no portal has launched, and no enrolment fees are being collected.

Anyone telling you to pay a registration fee right now is either confused or running a scam.

That said, the legal framework is already in place, and the clock is ticking toward a 2028 start. Here's what's actually confirmed.

What the Renters' Rights Act 2025 Created

Part 2, Chapter 2 of the Renters' Rights Act 2025 (Sections 64–74) authorises regulations requiring residential landlords in scope to join a landlord redress scheme. The Act received Royal Assent on 27 October 2025, and the statute uses the term "landlord redress scheme" rather than "ombudsman" — though MHCLG and housing policy documents call the operational body the PRS Landlord Ombudsman.

Section 64 itself does not require landlords to join now. It allows the Secretary of State to make regulations imposing a membership duty on residential landlords under assured or regulated tenancies. Any duty will be on the landlord; using a letting agent does not make the agent the landlord.

The Database and Ombudsman Timeline

The Act is rolling out in phases. The landlord ombudsman is part of Phase 2, Stage 2, after the regional PRS Database rollout begins:

Phase 1 — 1 May 2026 (complete): Section 21 no-fault evictions abolished. The vast majority of existing assured shorthold and fixed-term assured tenancies in the private rented sector converted to assured periodic tenancies. New rent increase rules (Form 4A) and pet request rights came into force.

Phase 2 — 15 December 2026 onward: The PRS Database launches regionally, starting with the West Midlands. All English regions will be live by November 2027. This is a separate registration (£65 per property per year) from the ombudsman.

Phase 2, Stage 2 — 2028 (projected): Mandatory landlord ombudsman membership. The Secretary of State must first designate or approve a scheme operator, then make separate membership regulations under Section 64 before any landlord is required to join.

The critical point: the regulatory design standards for the scheme (SI 2026/1033) came into force on 17 September 2026. That statutory instrument sets conditions a scheme must meet — governance, complaint handling, fee structures, remedies, and expulsion mechanisms. But SI 2026/1033 does not itself require landlords to register. Separate membership regulations are needed, and those remain unmade.

Why the Delay Matters

MHCLG's sequencing is deliberate. The government plans to introduce the ombudsman after the database and says it is exploring ways to share information between the systems to reduce sign-up work. The exact data-sharing arrangements and portal have not been announced.

The government roadmap says it expects to choose a scheme administrator at least 12 to 18 months before implementation, giving the operator time to scale up before mandatory membership begins.

What You Should Be Doing Now

The ombudsman will evaluate historical landlord conduct when investigating complaints. A dispute filed in 2028 can reference maintenance failings, communication breakdowns, and record-keeping gaps from 2026 and 2027. Waiting until the portal opens to start keeping proper records leaves you exposed.

Three things to set up today:

  1. A complaint log — track every tenant repair request, your acknowledgement, the contractor you instructed, and the completion date. The approved scheme will set the time members have to resolve complaints; SI 2026/1033 does not prescribe fixed acknowledgement or response deadlines.

  2. Communication records — save every email, letter, and text message exchange with tenants. Timestamp everything. The ombudsman's evidence requirements mean a verbal promise means nothing without a paper trail.

  3. Safety certification tracking — gas safety records, EICRs, and EPCs must be current where required. The PRS Database collects safety information; the government is exploring data sharing with the ombudsman, but its exact access to database records has not been announced.

Our PRS Landlord Ombudsman guide includes a dated compliance roadmap, ready-to-use complaint logs, and tenant response templates based on the scheme conditions in SI 2026/1033.

The Bottom Line

Mandatory membership is coming, but not yet. The projected start is 2028, pending appointment of a scheme operator and enactment of membership regulations. Do not pay anyone claiming to register you today. Do start building the complaint-handling records and audit trail that the ombudsman will inspect when it does launch.
