Landlord Registration vs Deposit Protection in Northern Ireland: Two Separate Duties
Two Systems, Completely Separate
One of the most common compliance mistakes in Northern Ireland is confusing landlord registration with deposit protection. They are different obligations, run by different bodies, with different deadlines and different penalties for non-compliance.
Landlord Registration is managed through the Landlord Registration Scheme at landlordregistrationni.gov.uk. Every landlord must register before letting a property — this gives you a Landlord Registration Number required on the Tenancy Information Notice (TIN). Operations are transitioning from the Department for Communities to local government (led by Lisburn & Castlereagh City Council).
Deposit Protection is managed through TDS Northern Ireland or mydeposits Northern Ireland — the two government-approved deposit scheme operators. When you take a tenancy deposit, you must protect it in one of these schemes within 28 calendar days and serve prescribed information on the tenant within 35 days.
Completing one does not complete the other. A landlord who registers on the landlord portal and assumes the deposit is covered has done nothing to protect the deposit.
Why the Confusion Is Dangerous
The confusion arises because both use online portals, both require registration, and both involve tenant-related paperwork. First-time landlords and accidental landlords often complete whichever one they encounter first and believe they have discharged all obligations.
The consequences of confusing them are severe:
Unregistered landlord, deposit protected: The deposit is protected, but the separate landlord-registration requirement still applies.
Registered landlord, deposit unprotected: The landlord registration is current, but the deposit breach continues under the Private Tenancies Act (NI) 2022 until it is remedied. A council can issue a fixed penalty notice equal to three times the deposit for failure to protect it or serve prescribed information; on summary conviction, the maximum fine for those breaches is £20,000.
Both scenarios leave the landlord exposed. Neither obligation substitutes for the other.
The Timeline at Tenancy Start
Here is what the first 35 days of a new tenancy look like when both duties are in play:
Before letting the property: Complete landlord registration and obtain your Landlord Registration Number.
Day 0 (deposit received): The 28-day deposit protection clock and the 35-day prescribed information clock both start. If the deposit was received in cash, issue a mandatory written receipt immediately.
Within 28 days of deposit receipt: Protect the deposit in TDS NI or mydeposits NI and obtain the Deposit Protection Certificate. Within 28 days of tenancy start: Serve the Tenancy Information Notice (which requires your Landlord Registration Number).
By day 35: Serve prescribed information on the tenant, including the scheme's official leaflet. Obtain the tenant's signed acknowledgement.
The Landlord Registration Number appears in the TIN, not in the deposit prescribed information — but both documents must be served within overlapping deadlines. A landlord who has not registered cannot properly complete the TIN, which creates a cascade of non-compliance.

Checking Your Status
Landlord Registration: Log into landlordregistrationni.gov.uk and confirm your registration is current and covers all properties you let.
Deposit Protection: Log into TDS NI (tdsnorthernireland.com) or mydeposits NI (mydepositsni.co.uk) and confirm each active tenancy's deposit appears with a valid Deposit Protection Certificate.
If either check reveals a gap, act immediately. Register as a landlord if unregistered and protect any unprotected deposit. Failure to protect a deposit or serve prescribed information is a continuing offence until the relevant duty is met.
The Tenancy Deposits in Northern Ireland guide maps both obligations onto a single compliance timeline so nothing falls through the gap between the two systems.
