Manchester Article 4 Direction: HMO Planning Permission Explained
Manchester City Council operates a borough-wide Article 4 Direction that removes permitted development rights for converting a single-family dwelling (Use Class C3) into a small HMO (Use Class C4, three to six unrelated occupants). Anywhere within the Manchester council boundary, you need formal planning permission to make that conversion. This is a separate requirement from landlord licensing — having one does not satisfy the other.
What the Article 4 Direction Does
Under normal permitted development rules, a homeowner can convert a C3 dwelling into a C4 small HMO without planning permission. Manchester's Article 4 Direction removes that right. If you want to convert a family home into a shared house for three to six unrelated people, you must submit a planning application to Manchester's planning department.
The Article 4 Direction applies across the entire Manchester City Council area, not just selective licensing wards. Even properties in areas with no selective licensing designation are covered.
Planning Permission and Licensing Are Separate
This is where landlords trip up. Getting an HMO licence does not give you planning permission. Getting planning permission does not give you an HMO licence. They are governed by different legislation (Town and Country Planning Act 1990 versus Housing Act 2004), administered by different council departments, and granted through different application processes.
An HMO operating without both the correct licence and the correct planning status faces dual enforcement: planning enforcement notices from the planning department and civil penalties from the housing enforcement team.
What Happens Without Planning Permission
If you apply for a mandatory HMO licence on a property that does not have established C4 planning use, Manchester City Council may issue a restricted 12-month licence instead of the standard five-year licence. This shorter licence reflects the planning uncertainty — you are essentially being given a year to resolve the planning position.
A 12-month licence costs the same application fee as a five-year licence. You pay the full Part A and Part B amounts for a fraction of the licence duration. Resolving the planning issue before applying avoids this entirely.

How to Check Your Planning Status
If the property has been used as an HMO continuously since before the Article 4 Direction took effect, it may have established lawful use — meaning the conversion happened when permitted development still applied. You can apply to the council for a Certificate of Lawful Use to confirm this.
If the property was converted after the Article 4 Direction came into force without planning permission, you need to apply retrospectively. Retrospective planning applications are treated the same as standard ones — the council assesses them against local planning policy, including HMO concentration thresholds.
Concentration Thresholds
When assessing C4 planning applications, Manchester enforces density policies. If the concentration of existing HMOs within a 100-metre radius of the property exceeds the local threshold, the application is likely to be refused. This policy aims to prevent neighbourhoods from becoming dominated by HMOs.
Check the council's planning records for existing HMO approvals near your property before investing in a planning application. A refusal still costs the application fee.
Larger HMOs (Sui Generis)
Properties with seven or more unrelated occupants fall outside both C3 and C4 use classes and into "sui generis" use. Converting to a large HMO always requires planning permission, regardless of any Article 4 Direction. The Article 4 Direction specifically covers the C3-to-C4 conversion for small HMOs (three to six people).
