Newham Property Licence Conditions: What Landlords Must Comply With

Getting your Newham property licence granted is not the finish line — it is the start of an ongoing compliance obligation. Every licence comes with conditions, and breaching any of them is a criminal offence under section 72(2) or section 95(2) of the Housing Act 2004. The penalties are the same as for operating without a licence: civil fines of up to £40,000 per offence under section 249A of the Housing Act 2004, or prosecution with an unlimited fine.

Quarterly Property Inspections

The licence holder must carry out a full property inspection at least once every three months. These are not casual drop-ins. Each inspection must be documented in a written log recording:

  • The inspector's name
  • The date and time of the inspection
  • Findings — the condition of the property, any maintenance issues, safety equipment checks
  • Remedial actions taken or scheduled

Newham Council can demand these inspection logs at any time, and you must produce them within 28 days of a written request. If you cannot show records of regular inspections, the council can treat that as a licence condition breach.

Tenant References

Before granting a tenancy, the licence holder must obtain pre-tenancy references for proposed occupiers. This means credit checks, employment verification and previous landlord references. The requirement is not optional — it is a condition of the licence.

The references do not need to follow a prescribed format, but you must be able to produce evidence that referencing was carried out if the council asks. A tenancy signed without any reference checks is a breach from day one.

Anti-Social Behaviour Protocols

Licence holders must take prompt, documented steps to investigate and resolve anti-social behaviour caused by occupiers or their visitors. This does not mean you are personally responsible for your tenants' behaviour, but you must demonstrate that you acted when issues were reported.

In practice, this means keeping a log of any ASB complaints received, the investigation steps you took, any warnings issued to the tenant, and the outcome. If Newham's environmental health or housing enforcement teams contact you about ASB at a licensed property and you have no records of action, that is a licence condition breach.

24-Hour Emergency Contact

Occupiers must be provided with a working 24-hour emergency contact telephone number and details of out-of-hours arrangements. This does not have to be your personal mobile — it can be a managing agent's emergency line or a property management service. But it must be operational, and tenants must have it from the start of their tenancy.

Property Condition and Maintenance

The licence conditions require the licence holder to maintain the property and all its installations — water supply, drainage, gas, electricity, communal areas, staircases, handrails, fire escape routes, fire doors, boundary fences and waste storage facilities. For HMOs, the Management of Houses in Multiple Occupation (England) Regulations 2006 add further layers: communal cooking and washing facilities must be maintained, refuse must not accumulate, and escape routes must remain clear.

Inventory

A comprehensive property condition inventory must be completed at the start of each tenancy and supplied to the tenant. This is separate from the deposit protection prescribed information requirement — it is a licence condition in its own right.

What Breach Looks Like in Practice

Newham's housing officers conduct risk-based compliance inspections and can request documentation. The licence holder must arrange access for officers when requested at a reasonable time. If they find missing inspection logs, no evidence of tenant referencing, or maintenance failures, they can serve a formal licence condition breach notice.

The enforcement route is the same as for unlicensed letting: a civil penalty notice of up to £40,000 per offence under section 249A of the Housing Act 2004, criminal prosecution, or a proposal to revoke or vary the licence. The council can also shorten a five-year licence to one year if it identifies management deficiencies.

The Newham Landlord Licensing Guide includes a post-grant compliance log template covering quarterly inspections, certificate renewal dates, tenant referencing records and ASB documentation — everything you need to demonstrate ongoing compliance if the council comes calling.
