Non-Resident Landlord Change of Letting Agent: Keeping Your Gross Approval

You've been receiving your UK rent gross for months, maybe years. You switch letting agents — and the new agency immediately starts withholding 20%. They tell you they have to. They're right.

Why Gross Approval Doesn't Follow You

The HMRC approval notice (Form NRL8) that authorises gross rent payment names a specific letting agent. It isn't tied to you as a landlord in a transferable way — it's an instruction to that particular agency. When you move to a new agent, that agent has no valid NRL8 notice in their name, and they're legally required to withhold basic-rate tax until HMRC issues one.

This catches many landlords who assume their approval travels with them. The outgoing agent's NRL8 is useless to the new agency, and photocopies or forwarded emails don't satisfy the statutory requirement. Only a fresh HMRC-issued notice addressed to the new agent will do.

How to Minimise the Withholding Gap

The gap between appointing a new agent and receiving the updated NRL8 is where you lose cash flow. You can't eliminate it entirely, but you can shrink it:

Notify HMRC before the switch completes. As soon as you know you're changing agents, write to HMRC Charities, Savings and International 1 (BX9 1AU) informing them of the change and requesting that a new approval notice be issued to the incoming agency. Include your UTR, the old agent's details, and the new agent's name and address.

Time the transition around quarter-ends. If possible, arrange for the handover to happen at the start of a new NRLS quarter (1 April, 1 July, 1 October, or 1 January). This gives HMRC more of the quarter to issue the new notice before the NRLQ filing and payment deadline, but the new agent must withhold until it receives its own notice.

Provide the new agent with your NRL1 confirmation. While they can't use the old NRL8, showing them your approved NRL1 status demonstrates you're already in the system. Some agents will note this internally even though they still must withhold until the new NRL8 arrives.

Factor in processing time. HMRC's general NRL application guidance gives a 2–4 week processing window, but there is no guaranteed turnaround for the new notice. Plan for withholding until the new agent receives it.

What Happens to Tax Withheld During the Gap

Tax your new agent withholds and sends to HMRC during the gap between their appointment and receiving the NRL8 cannot be refunded directly by the agent. It sits with HMRC until you file your annual Self Assessment return, at which point you claim it as a tax credit using the NRL6 certificate the new agent issues at year-end.

If the old agent also withheld tax in the same scheme year before the handover, you may receive NRL6 certificates from both agencies — one for the period each managed your property. Both credits apply to your tax return.

The Outgoing Agent's Obligations Don't End

Your old agent remains responsible for completing NRLQ returns and issuing NRL6 certificates for the period they managed your rental income. If they withheld tax in Q1 and you switched agents partway through Q2, the old agent must file their final NRLQ and provide you with an NRL6 covering their management period.

Make sure you receive these documents before the old relationship fully winds down. Once an agency closes your file, getting paperwork out of them can be slow.

Multiple Properties, Multiple Agents

If you own several UK properties managed by different agents, each agent needs their own NRL8 notice. Approval for Agent A doesn't extend to Agent B. If you consolidate management under one agency, the consolidated agent must wait for their own NRL8 before paying you gross — even if the agents being replaced all held valid notices.

Our Non-Resident Landlord Scheme guide includes a step-by-step agent-change protocol with a notification letter template, timeline for HMRC processing, and a tracking log for managing overlapping NRL6 certificates when you switch agencies mid-year.
