Non-Resident Landlord SA109: Self Assessment Filing for Overseas Landlords

You log into HMRC's Self Assessment portal, fill in your property income, and then discover you can't submit because the system doesn't support Form SA109 — the residence pages that every non-resident landlord must complete. It's the single most common technical blocker for expat landlords filing their UK tax returns.

Why SA109 Is Required

Form SA109 (Residence, Remittance Basis etc.) is where you declare your non-resident status, your usual place of abode, and your eligibility for the UK Personal Allowance. If you're a non-resident landlord with UK property income, HMRC requires it alongside your SA100 (main return) and SA105 (UK property supplement).

Without SA109, HMRC has no formal record of your residence status for the tax year, which affects everything from personal allowance eligibility to how your income is assessed.

The HMRC Online Filing Block

HMRC's free Self Assessment portal — the one you access through your Government Gateway account — does not support electronic submission of Form SA109. The portal physically won't let you complete the residence pages.

This isn't a bug or a temporary outage. It's a long-standing limitation of HMRC's free service. The SA109 notes published on GOV.UK explicitly state that online filing of these pages requires third-party commercial software.

This leaves non-resident landlords with two filing routes.

Option 1: Paper Return (Deadline 31 October)

You can download and print forms SA100, SA105, and SA109 from GOV.UK, complete them by hand, and post the whole return to HMRC at Benton Park View, Newcastle Upon Tyne, NE98 1ZZ. The paper deadline falls on 31 October following the end of the tax year — four months before the online deadline.

Paper filing is reliable and free, but the earlier deadline means you have less time to gather your figures. You also lose the automatic calculations that electronic filing provides, and international post adds delivery uncertainty.

Option 2: Commercial Tax Software (Deadline 31 January)

Several commercial software packages support SA109 and can submit returns electronically to HMRC. Options for non-resident property income include:

  • TaxCalc — desktop and online versions, property supplement included
  • GoSimpleTax — online-only, guided questionnaire format
  • Taxd — around £80 per return, aimed at straightforward non-resident filings

These tools let you file by the standard 31 January deadline, give you calculation checks as you go, and generate a digital submission receipt.

The cost typically runs £30–£80 per tax year depending on the provider and the supplements you need. For a landlord whose only UK income is property, this is usually the most practical route.

What Goes on Each Form

SA100 declares your overall personal tax position — total income, tax already paid (including any withheld under the NRLS), and your tax calculation.

SA105 is the UK property supplement. You'll enter gross rental income, itemised allowable expenses (agent fees, repairs, insurance, safety certificates), finance cost deductions, and your net taxable profit.

SA109 declares your residence status for the tax year, your country of residence, whether you're claiming the remittance basis, and your eligibility for the UK Personal Allowance under treaty or nationality provisions. If your agent withheld tax under the NRLS during the year, the NRL6 certificate they issue by 5 July documents the exact amount — you'll enter this as tax already paid to claim the credit.

Engaging a Tax Agent

If you'd rather not handle the filing yourself, you can authorise a UK tax agent using Form 64-8. The agent files electronically on your behalf using their own professional software. Fees for non-resident property returns typically range from £130 to £300+ depending on the complexity.

Be aware that authorising an agent via Form 64-8 restricts certain HMRC online services — for example, your NRL1 application must then be submitted by post rather than online.

Deadlines to Track

Route Deadline Where to File
Paper 31 October HMRC, Benton Park View, Newcastle, NE98 1ZZ
Online (commercial software) 31 January Via HMRC API through approved software

Late filing triggers an automatic £100 penalty, with additional daily penalties after three months and tax-geared penalties after six and twelve months.

Our Non-Resident Landlord Scheme guide includes a complete filing roadmap covering the SA109 submission process, NRL6 credit reconciliation, and a form-by-form walkthrough for each of the three return components — so you don't discover the portal block the evening before a deadline.
