Northern Ireland 28-Day Deposit Protection Deadline Explained
Not 30 Days — 28
If you have been reading generic UK landlord advice, you have probably seen the figure "30 days" for deposit protection. That is the English deadline. Northern Ireland's is shorter: 28 calendar days from the date you receive the deposit.
This is under Article 5B(3) of the Private Tenancies (Northern Ireland) Order 2006, as amended by the Private Tenancies Act (Northern Ireland) 2022. Before April 2023, the deadline was even tighter — 14 calendar days. The 2022 Act extended it to 28.
When the Clock Starts
The date the deposit money is physically or digitally received by you or your letting agent is the first day of the statutory period. Not the date the tenancy starts. Not the date the tenancy agreement is signed. The date the money arrives.
Calendar days are counted consecutively, including weekends and public holidays. There are no extensions for bank holidays, Christmas, or anything else.
If the tenant pays the deposit in instalments, each instalment triggers its own independent 28-day protection clock based on the date that specific payment is received. You cannot bundle them and protect the total when the last instalment lands — by then, the first instalment's deadline may have already passed.
What "Protected" Actually Means
The deposit is legally protected when the scheme confirms it. For a custodial scheme, that means the cleared funds have been received by TDS NI or mydeposits NI. For an insurance-backed scheme, that means you have paid the protection fee and the scheme has issued a Deposit Protection Certificate.
Initiating a bank transfer on Day 27 does not protect the deposit if the funds do not clear until Day 30. The clock runs until confirmation, not until you start the process.
Creating a scheme account, entering your landlord details, or starting a registration without completing it does not count. The 28-day deadline requires completed protection.

The 35-Day Prescribed Information Deadline
Northern Ireland operates a split deadline. On top of the 28-day protection deadline, you have a separate 35-day deadline to serve prescribed information on the tenant and any relevant third-party payer. Protecting the deposit on time does not exempt you from serving the information, and vice versa. Miss either one and you face the same penalties.
Missing the Deadline
If you discover that Day 28 has passed without the deposit being protected, protect it immediately. Under the 2022 Act amendments, failure to protect a deposit is a continuing offence. The breach runs every day from Day 29 until the deposit is safeguarded. Late protection stops the clock but does not erase the days of non-compliance.
District councils enforce these rules through Environmental Health departments. The penalties:
- Fixed Penalty Notice equal to three times the deposit
- Court prosecution with a summary fine up to £20,000
- No six-month time bar — councils can act years later for an unresolved breach
- Impaired Notice to Quit rights — you cannot lawfully end the tenancy while in breach
Holding Payments and the Clock
A holding payment taken to reserve a property before the tenancy agreement is signed is not a tenancy deposit during the reservation period. The 28-day clock does not start until the holding payment converts into a deposit — which happens on the date the tenancy agreement is executed and the payment is credited toward the security deposit.
Keeping Track of the Deadlines
Two separate clocks running from the same start date, with different endpoints, is exactly the kind of detail that gets missed in a busy self-managing landlord's schedule. Our Northern Ireland Tenancy Deposits guide maps both deadlines into a single compliance timeline with the specific operational steps for each window.
