Northern Ireland Tenancy Deposit Refund: The Landlord's Return Process

When the Tenancy Ends and the Deposit Must Move

At the end of a tenancy in Northern Ireland, the deposit held by an approved scheme needs to be returned, deducted from, or a combination of both. The process depends on whether the landlord and tenant agree on any deductions — and if they do not, Alternative Dispute Resolution (ADR) through the scheme decides.

Once the landlord and tenant agree how the deposit is to be divided, or an adjudication decision is issued, the agreed funds must be returned within 5 working days. Before agreement, the process depends on whether the deposit is held in a custodial or insured scheme.

The Standard Return Process

Step 1: Conduct the check-out inspection. Compare the property's condition against the check-in inventory prepared at the start of the tenancy. Photograph any damage beyond normal wear and tear. The check-out should happen on or within a few days of the tenancy end date.

Step 2: Calculate any deductions. Deductions can cover damage beyond fair wear and tear, unpaid rent, cleaning costs where the tenancy agreement requires the tenant to return the property in a specified condition, and any other contractual obligation the tenant failed to meet. Every deduction must be specific, itemised, and evidenced.

Step 3: Notify the tenant. Write to the tenant with the proposed breakdown — how much you intend to return and how much you propose to deduct, with evidence for each deduction. The tenant has the right to dispute any deduction.

Step 4: Agree and instruct the scheme. If both parties agree, log into the scheme portal (TDS Northern Ireland or mydeposits Northern Ireland) and submit the agreed split. In a custodial scheme, the scheme releases the funds within 5 working days; in an insured scheme, the landlord pays the agreed amount directly to the tenant within that period.

If there is no agreement: The parties can use the scheme's ADR service if both consent to binding adjudication. If either party refuses ADR, the dispute goes to court; if one party does not respond, the scheme's single-party claim process may apply. In custodial schemes, the scheme already holds the money and pays out per the adjudicator's decision. In insured schemes, the landlord must transfer the disputed amount to the scheme before ADR proceeds.

The Evidence Burden

ADR adjudicators in Northern Ireland place the full burden of proof on the landlord for any deductions. If the landlord claims £300 for carpet damage, the landlord must provide:

  • A dated check-in inventory signed by the tenant showing the carpet's condition at tenancy start
  • Photographs taken at check-in and check-out
  • Proof that the tenancy agreement requires the tenant to return the property in the condition it was received (accounting for fair wear and tear)
  • Evidence of the cost to rectify the damage (quotes, invoices, or receipts)

A landlord without a dated, signed check-in inventory will struggle to prove what condition the property was in at the start. Without that baseline, the adjudicator has no way to attribute damage to the tenant rather than to pre-existing conditions or normal wear and tear.

Full Refund Situations

If the tenant returned the property in good condition, paid all rent, and met all contractual obligations, the full deposit should be returned promptly. Log into the scheme, confirm zero deductions, and the scheme releases the entire amount to the tenant.

Once the full refund is agreed, it should be paid within 5 working days. If the parties disagree about whether any deduction is justified, either can request scheme ADR, subject to both parties' consent.

What If the Deposit Was Not Protected

If the deposit was never protected in an approved scheme, the formal scheme return process does not apply — there is no scheme holding the money. The landlord must return the deposit directly to the tenant. Failure to protect it is a continuing offence under the PTA 2022; a council can issue a fixed penalty equal to three times the deposit, and the maximum summary fine is £20,000. A tenant can also pursue a court claim to recover an unpaid deposit.

Return the deposit and protect yourself from escalation by acknowledging the failure and resolving it cleanly. This does not prevent the tenant from pursuing penalties, but it removes the immediate financial dispute from the equation.

Practical Tips for a Clean Return

Keep the check-in and check-out inspection records in the same file as the Deposit Protection Certificate and prescribed information. When the tenancy ends, everything you need to process the return or defend a deduction claim is in one place.

Respond to the tenant's return request within a few days, even if you need more time to assess deductions. Silence is interpreted as withholding.

The Tenancy Deposits in Northern Ireland guide includes a deduction schedule worksheet and an end-of-tenancy checklist that walks through the return process step by step, from check-out inspection to scheme release instruction.
