NT Landlord Notice of Termination — Form RT05 and RT03 Guide
Which Form Do You Need?
NT Consumer Affairs prescribes specific forms for each termination ground. Using the wrong one — or an outdated version pulled from a generic forms website — invalidates your notice before you even serve it. Here is the form register that matters for landlords.
Form RT05 — Notice of Intention to Terminate Tenancy Agreement (by Landlord/Agent)
This is the workhorse form. It covers five separate statutory grounds:
| Ground | Section | When to use it |
|---|---|---|
| No-ground periodic termination | s.89 | Ending a periodic tenancy without stating a reason (60 clear days notice post-2024) |
| Fixed-term expiry | s.90 | Ending a tenancy at the end of its fixed term (60 clear days before expiry post-2024) |
| Uninhabitable premises | s.86 | Premises flooded, unsafe, or access blocked for 3+ days (2 days notice) |
| Drug premises order | s.88A | Drug premises order in force under the Misuse of Drugs Act 1990 (14 days notice) |
| Employment tenancy | s.91 | Tenant's employment with landlord ended (14 days minimum) |
Form RT03 — Notice to Remedy Breach of Agreement: Unpaid Rent
Used specifically for rent arrears under section 96A. You can only issue this when rent is at least 14 days overdue. It gives the tenant a minimum 7 clear days to pay. If the tenant pays within the cure period, the notice expires and you cannot proceed to NTCAT on it.
NTCAT Form 1 — Initiating Application
Not a Consumer Affairs form. You file this directly with NTCAT when either the tenant has not complied with your Form RT03/RT05, or you are applying for immediate possession under section 88 (serious damage or unacceptable conduct — no preliminary notice required).
Filling Out Form RT05 Correctly
Section 101 of the Act lists six mandatory elements. Miss any one and the notice is void:
- Full legal names — both landlord (or agent) and tenant, matching the tenancy agreement exactly
- Property address — the exact address of the rented premises
- Statutory ground and section — tick the correct box on the form and cite the right section number
- Factual particulars — for breach or arrears grounds, detail the specific facts (dates, amounts, conduct)
- Termination date — the exact calendar date on which the tenancy ends and vacant possession is required. This date must allow the full clear-days notice period. Vacant possession becomes deliverable on the day after this date
- Signature and date of issuance
The most common fatal error: setting the termination date too early because of a miscounted notice period. Remember that NT notice periods use clear days — the service date and the termination date are both excluded from the count.
What Happens If Your Notice Has a Defect
You cannot amend a defective notice. A notice that cites the wrong section, has the wrong date, omits a required field, or uses an outdated form is invalid from the start. NTCAT will dismiss any application based on it.
The only fix is to formally withdraw the defective notice using Form RT07 (Withdrawal of Notice of Intention to Terminate) and serve a brand-new, correct notice. All statutory timeframes restart from scratch.

Where to Download Current Forms
Always download directly from the NT Consumer Affairs website — not from third-party form sellers like PDFfiller or US Legal Forms. Those sites frequently host legacy COVID-era versions with modified timeframes that no longer apply. The current Form RT05 (May 2025 version) is available from the Consumer Affairs residential tenancies forms page.
Putting the Form in Context
Selecting and filling in the form is one step in a longer process. The NT Ending a Tenancy Guide includes a ground-to-form register that maps every termination scenario to the right form and section, a notice pre-service audit checklist, and a clear-days calculation worksheet so you can set the termination date with confidence.
