NT Rental Bond Penalties for Landlords
How Bond Penalties Work in the NT
The Residential Tenancies Act 1999 expresses fines in penalty units rather than fixed dollar amounts. The value of one penalty unit is indexed annually on 1 July in line with the Darwin Consumer Price Index, published by NT Treasury under the Penalty Units Act 2009.
For the 2026/27 financial year, one penalty unit is worth $194. The figures below use that rate.
The Penalty Table
| Offence | Maximum penalty units | Maximum fine (2026/27) |
|---|---|---|
| Demanding a bond exceeding four weeks' rent | 20 | $3,880 |
| Failing to hold the bond in a compliant NT ADI trust account | 100 | $19,400 |
| Failing to issue a compliant written receipt | 10 | $1,940 |
| Failing to transfer bond custody when absent from the NT for more than 14 days | 20 | $3,880 |
| Unlawfully withholding a security deposit after the tenancy ends | Up to 100 | $19,400 |
These are the statutory maximum fines calculated at the 2026/27 rate.
The Two Biggest Exposures
Trust account non-compliance ($19,400). The NT has no central bond board. You hold the money yourself, and it must sit in a dedicated Authorised Deposit-taking Institution account in the Northern Territory, separate from your personal banking. Mixing bond funds with operating money or depositing them into an interstate account is an offence carrying up to 100 penalty units.
Unlawful withholding ($19,400). After the tenant vacates, you have seven business days to either refund the bond in full or serve a Section 112(5) Notice of Intention to Retain with itemised deductions, trade quotes, and a Statutory Declaration. Missing that deadline — or holding the bond without serving the notice — exposes you to the highest fine category in the bond provisions.

Common Mistakes That Trigger Penalties
Overcharging. A landlord who collects five weeks' rent as bond, or adds a separate pet deposit, has breached Section 29(1). The tenant can report the overcharge to NT Consumer Affairs, and the Commissioner of Tenancies can investigate.
No receipt or a deficient receipt. Section 31 requires a receipt with six specific fields (date, tenant name, amount, property address, co-tenant proportions, and your signature). Handing the tenant a generic bank transfer screenshot does not satisfy the statute.
Ignoring the 14-day absence rule. Self-managing landlords who travel interstate or overseas for more than 14 consecutive days without formally transferring bond custody to a licensed agent (and notifying the tenant in writing) commit a separate offence worth up to 20 penalty units.
Late bond return with no retention notice. This is the offence that catches landlords mid-dispute. You believe you are entitled to deductions, so you hold the bond while gathering quotes. If seven business days pass without a valid Section 112(5) notice, you have lost the legal right to retain any of it — and continued holding becomes unlawful withholding.
Enforcement in Practice
NT Consumer Affairs (NTCA) handles complaints and compliance enforcement. The Commissioner of Tenancies may investigate complaints and enforce statutory compliance. NTCAT (the Northern Territory Civil and Administrative Tribunal) adjudicates disputed bond claims and can make binding orders about how the security deposit is distributed.
NTCA's compliance role and NTCAT's bond-dispute role are separate: NTCAT determines how the security deposit is distributed, while NTCA handles compliance enforcement.
How to Stay on the Right Side
Every offence in the table above maps to a specific compliance step: calculate the bond correctly, open the right account, issue the right receipt, delegate when you travel, and meet the exit deadline. The NT Rental Bond Guide walks through each step with the forms and timelines built in.
