NTCAT for Landlords: Applications, Repair Orders and Filing Fees

What NTCAT Does

The Northern Territory Civil and Administrative Tribunal (NTCAT) is the independent body that hears residential tenancy disputes. It can enforce tenancy terms, award compensation, order repairs and distribute bond funds. Consumer Affairs NT handles education and compliance investigations, but when a dispute needs a binding decision, it goes to NTCAT.

Both landlords and tenants can apply. A landlord might apply for compensation for property damage, bond deductions a tenant contests, or a termination order. A tenant might apply for a repair order, compensation for loss of habitability, or a rent reduction.

Filing Fees (2026/27)

NTCAT fees depend on the claim value and whether the applicant is an individual or a corporate entity.

Claim Value Individual Fee Corporate Fee
Under $2,000 $84 $105
$2,000 to $10,000 $259 $324
Over $10,000 (up to $25,000) $518 $648
Non-monetary (e.g. repair order) $84 $105

If you are applying for a repair order with no monetary claim attached, the fee is the minimum $84 for an individual. Fee waivers are available for applicants experiencing severe financial hardship — lodge an NTCAT Form 8 (Request for Fee Waiver or Reduction) with supporting financial records at the time of filing.

How to File

The process follows a set sequence:

  1. Complete Form 1 — the Initiating Application, detailing the grounds of the dispute
  2. Pay the filing fee — or lodge a Form 8 fee waiver application at the same time
  3. Serve the respondent — deliver sealed copies of Form 1 and any NTCAT directions to the other party within 7 to 14 days
  4. Attend hearings — both parties must attend directions conferences, mediation sessions or final hearings as scheduled

NTCAT encourages mediation before a full hearing. Many tenancy disputes are resolved at the mediation stage, which is faster and less formal than a hearing.

Repair Orders

A repair order is one of the most common outcomes in tenancy disputes. If NTCAT finds that a landlord has failed to maintain the property to the standard required under the implied warranties in the Residential Tenancies Act 1999, it can order the landlord to carry out specific repairs within a set timeframe.

The order is legally binding. Keep a copy with your repair records and follow the timeframe set out in it.

From a landlord's perspective, keep evidence of your response to the tenant's written repair notice. For emergency repairs, records showing that you began work or notified the tenant of arrangements within 5 business days and completed the work within 14 calendar days show whether you met those timelines.

Compensation Claims

Tenants can claim compensation for losses caused by a landlord's breach of their obligations. This might include the cost of alternative accommodation if the property became uninhabitable, the cost of self-help repairs the tenant arranged after the landlord missed the statutory deadline, or a rent reduction for a period when the property was not fully habitable.

Landlords can claim compensation too — for property damage beyond fair wear and tear, for cleaning costs when the property was left in poor condition, or for rent arrears.

Practical Takeaway

NTCAT exists to resolve disputes when the parties cannot agree. The filing fees are modest compared to the cost of most property disputes, which means neither party faces a financial barrier to applying. For landlords, the implication is clear: maintaining the property, responding to repair requests within the statutory deadlines and keeping written records of everything is cheaper than defending an NTCAT application.

The NT Rental Minimum Standards guide covers the repair and entry obligations that generate most NTCAT disputes, with the timelines and record templates built in.
