NWT Ending a Tenancy Checklist: Landlord Compliance Steps
Before You Serve Anything
The compliance chain starts well before a notice goes out. These pre-notice checks determine whether your termination will survive scrutiny at a Rental Officer hearing:
- Entry and exit inspection reports completed? Sections 15 and 17.1 require inspections at the beginning and end of a tenancy, with reasonable opportunities for the tenant to participate and copies of each report within five days after its inspection. For tenancies entered into on or after September 1, 2010, Section 18(5) bars retaining a deposit for repairs of damage if either report is missing or a copy was not provided without a reasonable excuse accepted by the Rental Officer. This does not bar deductions for rent arrears under Section 18(4).
- Tenancy agreement copy provided? The tenant must have received a copy of the signed agreement within 60 days.
- Limitation window open? Applications to the Rental Officer generally must be filed within six months of the disputed event. Under Section 68(3), the Rental Officer may extend the time, even after it expires, if the officer considers that an extension would not be unfair.
Failing any of these means the termination process has a structural weakness before it begins.
Identifying Your Ground
NWT landlords cannot end a periodic tenancy without cause (no arbitrary 30-day or 60-day notices). Your termination must fit one of the statutory grounds:
- Non-payment of rent (Section 41)
- Property damage (Section 42)
- Disturbance or noise (Section 43)
- Uncleanliness or hazard (Section 45)
- Overcrowding (Section 45(3))
- Illegal activity (Section 46)
- Landlord personal occupation (Section 58(1)(a))
- Purchaser occupation (Section 58(1)(b))
- Demolition, major repair or conversion (Section 59)
The single exception: if the rental property is your only residence in the NWT, you can give unilateral written notice — 30 days for a fixed-term ending (Section 51(2)) or 90 days for a monthly tenancy (Section 52(2)). Public housing landlords have separate notice provisions.
Service and Date Calculation
If you are serving a written notice (single residence exemption), it must take effect on the last day of a rental period. Give at least 30 days' notice before the end date for a term tenancy or 90 days before the last day of a periodic tenancy.
Section 71 allows personal service, registered mail, fax if a fax number is provided, or a method set out in the regulations. Regular mail or text messages are not listed as permitted service methods.
Keep records showing how and when the notice was served. If an eviction order later needs to be filed for a writ of possession, Section 86.1 requires an affidavit of service of that order and an affidavit that it was not obeyed.

Filing With the Rental Officer
For cause-based terminations, you file directly with the Rental Officer — no prior written notice to the tenant is required for most grounds. The filing package needs:
- Three copies of the completed landlord application form (March 2026 edition)
- Three sets of supporting documents (tenancy agreement, account ledger, receipts or invoices, notices or letters, inspection reports, photographs or videos, and other relevant records)
- $100 filing fee paid to GNWT Financial Shared Services
Submit in person or by mail in triplicate to the NWT Rental Office, or electronically via the GNWT Secure File-Drop portal. Filing fees can be paid in person at Financial Shared Services offices in Yellowknife, Hay River, Inuvik, Fort Smith, Fort Simpson or Norman Wells.
After the Hearing
If the Rental Officer grants a termination and eviction order and the tenant does not leave, enforcement requires filing with the Supreme Court of the NWT within six months. You submit an Affidavit of Non-compliance, certified copies of the order and its service affidavit, a court backer and a draft Writ of Possession. The Sheriff's Office then executes the physical eviction.
Never change locks, disconnect utilities or remove a tenant's belongings yourself. Section 48(1) prohibits terminating a tenancy except in accordance with the Act. Section 91(1) makes listed conduct, including withholding a vital service or harassing a tenant to force them to leave, an offence punishable on summary conviction by a fine of up to $2,000.
