Oxford Landlord Licence When Selling Property: Transfers, Variations, and What to Do

Licences Don't Transfer to a New Owner

A property licence is issued to a specific licence holder — usually the person who owns the property and controls the letting. When ownership changes, the licence doesn't follow the bricks. The existing licence lapses, and the new owner needs to apply for their own.

This catches buyers by surprise. The seller's licence doesn't transfer, and the buyer needs to submit a new application. If a new application is submitted more than 12 weeks after the property became licensable, the higher-rate fee is £1,803 for selective or £3,190 for HMO (2026/27 rates).

What the Seller Should Do

If you're selling a tenanted rental property, your licence remains valid until the sale completes. After completion, you're no longer the landlord and the licence has no practical effect — you can't be the licence holder for a property you don't own. The existing licence holder must request formal revocation from the council.

The council doesn't automatically revoke the licence on sale. But once Stage 1 and Stage 2 fees have been paid and a final licence issued, there's no refund for the remaining licence period. The fees cover the cost of processing and administration, not a per-day entitlement.

If the property is being sold with vacant possession (no tenants), consider whether a Temporary Exemption Notice is appropriate. A TEN exempts the property from licensing for three months while genuine steps are taken to remove the licensing obligation — selling vacant qualifies.

What the Buyer Should Do

If you're buying a let property in Oxford:

Check licensing status before completion. Ask the seller for the current licence, check the council's public licensing register, and confirm which scheme applies to the property.

Apply as soon as ownership changes. The licence does not transfer to the buyer. For an HMO, Oxford requires an application as soon as the property is occupied as an HMO and accepts applications up to four weeks before occupation. For selective licensing, applications can be submitted up to four weeks before the tenancy starts. The standard new fee depends on proving that the property was purchased or became licensable within the preceding 12 weeks.

Prepare your documents in advance. The seller's gas certificate, EICR, and EPC may still be in date. Confirm validity, get copies, and check whether they'll remain current through your application period.

Licence Variations vs New Applications

Minor changes during the life of a licence — updated contact details, a reduction in occupancy numbers — can be handled through a licence variation at no cost. But a change of licence holder (i.e., the property changing ownership) is not a minor variation. It requires a new application.

A change of manager where the new manager becomes the primary licence holder ends the existing licence and requires a new application. If the licence holder stays the same, check with the council whether a variation is required.

The distinction matters: variations are free; new applications carry full fees and the two-stage process.

The Gap Between Licences

When ownership changes, there's inevitably a gap between the old licence (which relates to the previous owner) and the new one (which the buyer needs to apply for). During this gap, the property is technically unlicensed.

The buyer should submit the new application as soon as the licensing obligation arises. A pending application does not itself grant a licence or guarantee protection from enforcement.

The strongest position is a complete application submitted promptly, with all documents ready.

Our Oxford landlord licensing guide covers the sale and purchase transition in detail, including the document handover checklist and the 12-week timeline — so new owners don't stumble into higher-rate territory.
