PEI Landlord Notice Periods: How Much Notice You Must Give to End a Tenancy
Every Notice Period Under the Act
The Residential Tenancy Act (in force April 8, 2023) prescribes specific minimum notice periods for each termination ground. These aren't suggestions — serve a notice that's even one day short and, while Section 54 may adjust the date forward, you've lost time you could have spent on a correctly calculated notice.
Here's the full table:
| Ground | Form | Minimum Notice |
|---|---|---|
| Non-payment of rent (s. 60) | 4A | 20 days |
| Cause, damage, or disturbance (s. 61) | 4A | 1 month |
| Landlord or family personal use (s. 62) | 4B | 4 months |
| Purchaser personal use — purchaser occupying (s. 63) | 4B | 2 months |
| Purchaser personal use — purchaser's family (s. 63) | 4B | 4 months |
| Demolition or conversion (s. 64) | 4B | 6 months |
| Major renovations (s. 64, after Form 6 approval) | 4B | 6 months |
| Demolition, conversion, or renovation for tenant who owns a mobile home (s. 64) | 4B | 12 months |
| Loss of housing subsidy eligibility | 4B | 4 months |
| End of employment (s. 66) | 4A | 1 month; not before the last day of employment |
How to Count the Notice Period
Two rules govern the calculation:
The start date: The notice period begins the day after the tenant receives (or is deemed to receive) the form. If you mail the notice, add 3 days — Section 100 deems mailed documents received on the third day after posting. So if you mail on October 2, deemed receipt is October 5, and the 20-day clock for a non-payment notice starts October 6.
The end date (rent-cycle alignment): For every ground except the 20-day non-payment notice, the effective vacate date must fall on the day before rent is due. If rent is payable on the 1st, the notice must expire on the last day of a month.
This means you can't just count 4 months forward and land on the 15th. If you serve a landlord personal-use notice on May 15 with rent due the 1st, four months forward lands on September 15 — but the rent-cycle alignment rule pushes the effective date to September 30. Plan your timeline accordingly.
What Happens When the Date Is Wrong
Section 54 provides a partial safety net: if your notice specifies an effective date that's too early, the law automatically adjusts it to the earliest compliant date. You don't lose the notice, but you do lose time.
Section 54 only adjusts effective dates. It does not itself cure other defects. The Director may determine a notice's validity and set aside or amend one that does not comply with the Act.

Practical Example: Mailed Notice for Personal Use
Your tenant pays rent on the 1st. You want to move your parent into the unit.
- You mail Form 4B on June 3
- Deemed receipt: June 6 (3-day mail rule)
- Four-month minimum from June 6: October 6
- Rent-cycle alignment: the notice must end on the day before the 1st, so October 31
- Earliest valid effective date: October 31
If you'd used personal delivery on June 3, receipt would be June 3, and the earliest aligned date would still be October 31 — but you'd have saved 3 days on the dispute window calendar.
Don't Forget Compensation Timing
For Form 4B grounds (personal use, purchaser use, demolition, renovations), you must provide the required compensation or, where allowed by the Act, offer another rental unit acceptable to the tenant. Compensation is due on or before the effective vacate date. The notice period isn't just about when the tenant leaves — it's also the deadline for getting compensation right.
Our Ending a Tenancy in PEI guide includes a deemed-service worksheet and notice-period calculator that accounts for mail deeming, rent-cycle alignment, and compensation deadlines for every ground.
