Penalty for Letting Without a Licence in Brent

The Maximum Penalty Is £40,000 Per Offence

Under section 249A of the Housing Act 2004 (as amended by Phase 1 of the Renters' Rights Act 2025, effective 1 May 2026), Brent Council can issue a civil financial penalty of up to £40,000 for each licensing offence. Operating without a selective licence and operating without an HMO licence are separate offences, but the applicable offence depends on which licence the property requires.

The penalty amount is set on a case-by-case basis, taking into account the severity of the offence, the landlord's compliance history, the deterrent effect, and whether the landlord profited from non-compliance.

Criminal Prosecution

Instead of a civil penalty, the council can prosecute. A conviction in the Magistrates' Court for operating an unlicensed HMO (section 72 of the Housing Act 2004) or an unlicensed selectively licensable property (section 95) carries an unlimited fine. For breaching specific licence conditions, fines run up to £5,000 per breach.

Brent chooses between a civil penalty and prosecution — it cannot do both for the same offence. In practice, civil penalties are more common because they are faster to issue and do not require the criminal burden of proof.

Rent Repayment Orders

This is where the financial pain escalates. Under Chapter 4 of the Housing and Planning Act 2016 (expanded by the Renters' Rights Act 2025), tenants or the local authority can apply to the First-tier Tribunal for a Rent Repayment Order.

For offences committed after 1 May 2026, the Tribunal can order the landlord to repay up to 24 months of rent. A tenant paying £1,500 a month could claim back £36,000. The Tribunal application is separate from any council penalty — both can apply to the same period of unlicensed operation.

The tenant does not need the council's involvement to apply. All they need is evidence that the property required a licence and did not have one.

Blocked Possession Notices

While a property is unlicensed, serving possession notices is legally compromised. Under the Renters' Rights Act 2025, Section 8 grounds are the only route to possession, and operating without a required licence leaves the landlord exposed to a successful Tribunal defence.

A tenant who discovers the property is unlicensed has leverage. They can apply for an RRO, while any possession claim follows the separate Section 8 process.

The Rogue Landlord Database and Banning Orders

Repeat offenders or landlords committing serious housing offences face entry on the national database of rogue landlords. From there, Brent Council can apply for a Banning Order — prohibiting the individual from managing any residential lettings in England.

How Brent Enforces

Brent Council's enforcement process follows a standard sequence:

  1. Investigation (often triggered by tenant complaint, register check or council proactive sweep)
  2. Notice of Intention to impose a civil penalty, stating the proposed amount
  3. Opportunity for the landlord to make written representations
  4. Final Notice confirming the penalty
  5. 28-day window to appeal to the First-tier Tribunal

Submitting a complete licence application with Part A payment at any point creates a statutory defence against prosecution for the unlicensed-letting offence going forward. But it does not undo penalties already incurred or block RRO claims for the period the property was unlicensed.

The Practical Cost

A landlord who delays licensing by a year on a single selective property risks: a civil penalty (potentially thousands of pounds), a tenant RRO claim of up to 24 months' rent, and the cost and disruption of a Tribunal process. The licence fee for a selective property is £640.
