Private Tenancies Act Northern Ireland 2022 for Landlords

What Changed for Landlords

The Private Tenancies Act (Northern Ireland) 2022 — which received Royal Assent on 27 April 2022 and whose provisions have come into force in phases — was the most significant reform to Northern Ireland's private rented sector since the original Private Tenancies (Northern Ireland) Order 2006 established the framework.

For landlords, the 2022 Act didn't create a new registration system. It strengthened the enforcement teeth behind the existing one and tightened several related obligations.

Enhanced Fixed Penalty Notices

The original scheme under the 2006 Order allowed councils to issue Fixed Penalty Notices for non-registration. The 2022 Act modified Article 68A to make these penalties more consequential.

Under the revised provisions, if a landlord pays an FPN (up to £500) but remains unregistered for more than 14 days afterward, they commit a further offence. The council can issue additional penalties or proceed directly to prosecution — the payment doesn't buy time to keep ignoring the registration requirement.

Continuing Offence With No Time Bar

The 2022 Act provides that failure to register is a continuing offence, with no statutory time limit on prosecution.

A council can pursue enforcement regardless of how long the non-registration has persisted. For landlords who've been letting unregistered for years, the exposure doesn't diminish with time.

Tenancy Deposit Reforms

The 2022 Act tightened deposit protection rules. Deposits remain capped at one month's rent and must be protected in an approved scheme within 28 days. Prescribed Information must be served within 35 days. Deposit non-protection is a continuing offence. Non-compliance can carry a council Fixed Penalty Notice of up to three times the deposit amount or a court fine up to £20,000.

Tenancy Information Notices

A new requirement under the 2022 Act: landlords must serve a written Tenancy Information Notice (TIN) to tenants free of charge within 28 days of granting a tenancy. The notice sets out the tenancy terms and must include the landlord's registration number.

Changes to tenancy terms during the letting require a Notice of Variation.

Tiered Notice to Quit Periods

The 2022 Act replaced the previous flat notice periods with a tiered system based on how long the tenant has been in occupation:

Continuous tenancy Minimum landlord notice
Up to 12 months 4 weeks
12 months to 10 years 8 weeks
Over 10 years 12 weeks

Longer-term tenants get more notice before a tenancy can end. These are minimums — landlords can always give longer notice.

The Legislative Stack

Northern Ireland's landlord registration sits on a three-layer legislative foundation:

  1. Private Tenancies (Northern Ireland) Order 2006 — the primary enabling order, establishing Article 65A (registration duty) and the overall regulatory framework
  2. Landlord Registration Scheme Regulations (Northern Ireland) 2014 — the operational detail: fees, data requirements, public register rules, three-year cycle, joint-owner keycodes
  3. Private Tenancies Act (Northern Ireland) 2022 — the enforcement upgrade: continuing offences, enhanced FPNs, deposit and notice reforms

The Department for Communities oversees private rented sector policy across Northern Ireland, while Lisburn & Castlereagh City Council handles day-to-day registration administration and the eleven district councils enforce compliance.

For a practical walkthrough of how these legislative requirements translate into action steps, the Northern Ireland Landlord Registration Guide covers the complete process with dated compliance deadlines.
