Queensland Tenancy Notice Periods: Every Ground and Timeline for Landlords

Notice Periods by Termination Ground

Under the Residential Tenancies and Rooming Accommodation Act 2008 (RTRA Act), each lawful ground for ending a tenancy carries its own minimum notice period. The period runs from the day the tenant is deemed to have received the Form 12 Notice to Leave to the handover date.

Ground General Tenancy Rooming Accommodation
End of fixed term (s 291) 2 months 14 days
Unremedied rent arrears (s 281) 7 days Immediate if under 28 days; 4 days if 28+ days
Unremedied general breach (s 281) 14 days 2 days
Non-compliance with QCAT order (s 282) 7 days 7 days
Sale contract (s 286) 2 months 1 month
Owner/family occupation (s 290G) 2 months N/A
Significant repair (s 290D) 2 months 1 month
Demolition/redevelopment (s 290C) 2 months 2 months
Change of use (s 290E) 2 months 1 month
Non-liveability (s 284) Immediate Immediate
Employment termination 4 weeks 1 month

Breach-related grounds also require a preliminary Form 11 remedy period — 7 clear days for rent arrears, 14 clear days for general breaches — before the Form 12 can be issued.

How Clear Days Work

Day-based Queensland notice periods use "clear days" under section 38 of the Acts Interpretation Act 1954. Periods stated in months mean calendar months. The rules:

  1. Day 0 — the day the notice is served or deemed received. This day does not count toward the notice period.
  2. Day 1 — the notice period starts at midnight following Day 0.
  3. Final day — the notice period expires at midnight on the last calculated day.
  4. Handover date — the last day of the notice period stated on Form 12. The tenant must be allowed until midnight that day to leave; the next action may occur the following day. If the notice period ends on a weekend or public holiday, it moves to the next business day.

A 7-day notice served (in person) on Monday the 5th: Day 0 is the 5th, days 1–7 run Tuesday the 6th through Monday the 12th, and the handover date is Monday the 12th. The tenant may stay until midnight; the next action may occur on Tuesday the 13th.

Postal Days Add to the Timeline

If you serve the Form 12 by post rather than in person, the notice is not deemed received on the day you mail it. You must add Australia Post delivery days before the notice period begins counting. Depending on location and postage class, this adds 2–6 business days. The practical effect is that a "2 month" notice period served by ordinary post requires closer to 2 months plus a week of lead time.

Email is received when it enters the recipient's email server; SMS receipt time is determined under section 24 of the Electronic Transactions (Queensland) Act 2001. The tenancy agreement must record consent to the electronic method used.

Fixed-Term Tenancy Restrictions

For several grounds — end of fixed term, owner occupation, significant repair, demolition, and change of use — the handover date cannot be earlier than the fixed-term expiry date, even if the two-month notice period would otherwise expire sooner. The sale ground under section 286 cannot be used during a fixed term at all.

Grounds that can end a fixed term early include unremedied breach, non-compliance with a QCAT order, non-liveability, and QCAT termination applications for excessive hardship, damage or injury, objectionable behaviour, serious breach, or repeated breaches. Serious-breach applications are non-urgent and require RTA dispute resolution first; urgent applications can be filed directly with QCAT.

What Happens if the Period Is Too Short

Section 349 of the RTRA Act allows QCAT to make a termination order despite a defect in the Form 12 if that is appropriate in all the circumstances. If the handover date is short, do not rely on that discretion: issue a fresh Form 12 with a corrected date and restart the calculation.

The Ending a Tenancy in Queensland guide includes notice period tables for every ground, worked clear-day calculation examples, and a timeline tracker worksheet that factors in postal transit days.
