Rent Reduction at QCAT in Queensland: A Landlord's Guide

When Tenants Can Apply for a Rent Reduction

Under the RTRA Act, QCAT has broad powers to reduce rent when a rental property fails to meet the minimum housing standards prescribed in Schedule 5A of the RTRA Regulation 2009. Since 1 September 2024, these standards apply to every residential tenancy in Queensland — no exceptions for older leases or longstanding arrangements.

For a minimum housing standards failure, the tenant can serve a Form 11 Notice to Remedy Breach. The standard cure period is seven days from service. If the defect is not rectified, the tenant can request RTA conciliation using Form 16 or apply directly to QCAT for an urgent repair order without first completing conciliation. QCAT can direct rent to be reduced to compensate for loss of amenity until repairs are fully executed; the order sets the reduction and its period.

The reduction amount depends on how severely the breach affects the tenant's use and enjoyment of the property. A non-functioning cooktop in a property that is otherwise compliant might result in a modest weekly reduction. A persistent roof leak flooding the living area could justify a substantial one.

How QCAT Calculates the Reduction

QCAT does not follow a fixed formula. The adjudicator weighs the nature of the breach, the proportion of the property affected, how long the breach has persisted, and the landlord's responsiveness.

Factors that increase the reduction:

  • Multiple concurrent breaches (mould, broken locks, and a faulty cooktop compound the loss of amenity)
  • Evidence the landlord was notified repeatedly and failed to act
  • The breach affects a core living area (bedroom, bathroom, kitchen) rather than a secondary space
  • The tenant can show they explored alternatives (staying with family, hotel costs) because the property was uninhabitable

Factors that limit the reduction:

  • The landlord acted promptly after notification but trade contractor availability caused delays
  • The breach affects a minor feature that does not substantially diminish the property's habitability
  • The tenant contributed to the problem (e.g., mould caused by tenant behaviour rather than structural defects)

QCAT can direct a rent reduction until repairs are fully executed. Do not assume the reduction automatically starts on the date the tenant first reported the issue; check the order for the period it covers.

Defending a Rent Reduction Claim

Your defence rests on two pillars: proving the property was compliant, or proving you responded reasonably once you knew about the problem.

If the property met minimum housing standards at the time the tenant claims it did not, your Form 1a Entry Condition Report and periodic inspection records are your primary evidence. Dated photographs, smoke alarm test logs, safety switch test records, and trade invoices showing recent maintenance all demonstrate compliance.

If a genuine defect existed and you could not fix it instantly, show what you did and when. A communication log showing you contacted a licensed plumber within hours of a burst pipe report, that the plumber attended the next day, and that the repair was completed within three days demonstrates reasonable conduct even if the tenant was inconvenienced.

What does not work as a defence: claiming the repair was too expensive, arguing that a tenant's reporting duties remove your maintenance obligation, or blaming the body corporate without evidence you pursued them for the fix.

Preventing Rent Reduction Claims

The cheapest rent reduction is the one that never happens. Every dollar spent on proactive maintenance saves multiples in lost rent, tribunal costs, and the stress of a contested hearing.

Conduct a pre-tenancy compliance audit against all nine Schedule 5A standards before every new lease or renewal. During the tenancy, respond to repair requests within 24 to 48 hours with at least an acknowledgement and a timeline for the fix. For emergency repairs — anything affecting minimum housing standards — have a nominated contractor ready to attend the same day.

Keep a maintenance log for every property. When QCAT sees a landlord with a history of prompt responses and documented inspections, they are far less likely to order rent reductions even when an isolated defect slipped through.

The Rental Minimum Standards in Queensland guide includes the full pre-tenancy audit checklist and the repair workflow timeline that demonstrates reasonable landlord conduct at QCAT.

The Cost of Ignoring the Risk

A rent reduction order is not just a one-time payment. QCAT can order the reduced rate to continue until the repair is confirmed complete, with proof. If the landlord still does not act, the tenant can return to QCAT for further orders including tenancy termination.

For a property renting at $550 per week, even a 15% reduction means $82.50 per week in lost income. Over three months of inaction, that totals $1,072.50 — almost certainly more than the repair would have cost in the first place.
