Rent Repayment Orders in Wales: What Landlords Need to Know
When a Rent Repayment Order Can Be Made
A Rent Repayment Order (RRO) under section 32 of the Housing (Wales) Act 2014 is a remedy for specified Rent Smart Wales licensing offences. A tenant or contract-holder may apply where the landlord committed an offence such as:
- Unlicensed property management — carrying out property-management work without a required Rent Smart Wales licence (section 7(5))
- Allowing unlicensed management — knowingly allowing an unlicensed person to carry out property-management work (section 13(3))
The licensing authority or local housing authority may also apply in the circumstances set out in section 32. A fitness breach under section 91 or failure to comply with an Improvement Notice does not, by itself, create an RRO under this Welsh scheme. For a tenant's application, the Residential Property Tribunal's form requires evidence of a conviction for a qualifying licensing offence or, in relevant benefit-funded cases, an earlier authority RRO.
How Much Is at Stake
The tribunal can order repayment of up to 12 months' rent. The exact amount depends on the tribunal's assessment of several factors:
- The severity and duration of the offence
- Whether the landlord's behaviour was deliberate or negligent
- The landlord's financial circumstances
- Whether the landlord has a previous record of housing offences
- The amount of rent the contract-holder actually paid during the relevant period
The tribunal has discretion to reduce the amount if, for example, the landlord acted promptly once they became aware of the problem. But the maximum is 12 months of whatever rent was actually paid — for a property let at £800 per month, that is £9,600.
The Connection to Fitness Compliance
An RRO is separate from the civil fitness duty. A missing or expired EICR, non-compliant alarms, or an unfitness finding does not by itself qualify for a Welsh RRO. A qualifying Rent Smart Wales licensing offence may support an RRO, while section 91 separately makes rent not payable during an unfit period and allows advance-paid rent for that period to be recovered as a debt or offset against future rent.
The contract-holder can pursue both routes where both apply: the section 91 rent consequence for the unfit period, plus an RRO application for a separate qualifying licensing offence. The RRO concerns qualifying offence-related rent; section 91 means rent is not payable for days the dwelling is unfit, and advance-paid rent for those days may be recovered or offset.

How the Tribunal Process Works
The contract-holder files an application with the Residential Property Tribunal Wales, setting out the offence, the period, and the amount of rent paid. You receive the application and have the opportunity to respond in writing.
The tribunal may decide the application on written representations if it considers that appropriate and no party requests a hearing; it may also require an oral hearing. You can present evidence relevant to the licensing offence, compliance, or the amount sought.
If the tribunal finds in the contract-holder's favour, it makes an order specifying the amount to repay. The order is enforceable as a court judgment.
How to Reduce Your Exposure
The strongest defence against an RRO is not needing one: maintain valid safety certificates, comply with Rent Smart Wales registration and licensing, respond to Improvement Notices within the required timeframe, and keep documented proof of everything.
If you receive an Improvement Notice, deal with it on its own terms and within the notice's timetable. It does not, by itself, create a Welsh RRO under the Housing (Wales) Act 2014.
Keep your audit trail current: EICR dates, gas safety certificate renewals, alarm testing records, Rent Smart Wales registration confirmations, and proof of document service to contract-holders. If a contract-holder applies for an RRO, your first request from the tribunal will be for these records.
