Scotland Landlord Registration Fit and Proper Person Test: What Councils Check
What the Fit and Proper Test Actually Assesses
Every landlord registration application in Scotland goes through a "fit and proper person" assessment under Sections 84 and 85 of the Antisocial Behaviour etc. (Scotland) Act 2004. The local council must be satisfied that you — and any letting agent you declare — are suitable to let residential property.
This is not a background check in the police-vetting sense. The council evaluates four specific categories of concern, and a single issue does not automatically mean refusal.
The Four Assessment Categories
Criminal convictions. Councils consider convictions involving fraud, dishonesty, violence, firearms, sexual offences, or drug-related offences. A relevant conviction is a factor in the fit-and-proper assessment, not an automatic refusal.
Unlawful discrimination. Any adverse court or tribunal judgment under the Equality Act 2010 — or its predecessor statutes covering sex, race, or disability discrimination — is a material consideration. A landlord found to have discriminated against a prospective tenant may face closer scrutiny.
Housing law non-compliance. Past enforcement actions, breaches of the Repairing Standard, failure to protect tenancy deposits, or previous removal from the landlord register all count here. A landlord who has been served a Repairing Standard Enforcement Order (RSEO) by the Housing and Property Chamber and failed to comply is demonstrating exactly the kind of behaviour the test is designed to catch.
Antisocial behaviour. Actions — or failures to act — regarding antisocial behaviour connected to properties the applicant owns or manages. Active Antisocial Behaviour Orders (ASBOs) or notices linked to the applicant or their tenants are material.
How the Assessment Works in Practice
Councils use a risk-based framework. They may request additional information when an application raises concerns or when they audit safety declarations.
Where a council identifies a potential concern — a disclosed conviction, a complaint history, or a previous removal — it may request additional information before making a decision, including copies of safety certificates.
Glasgow City Council is known for a particularly thorough approach, embedding detailed safety compliance questions directly into the application form. Edinburgh conducts routine random sampling of certificates even for straightforward applications.

What Happens If You Fail
If the council is not satisfied that you are fit and proper, it must formally refuse the application. You receive a written notification explaining the reasons for refusal.
You can appeal to the Sheriff Court via a summary application under Section 92 of the 2004 Act. The appeal must be lodged within 21 days of the refusal notice. The Sheriff can overturn the decision and direct the council to register you. A further appeal on a point of law can go to the Sheriff Principal, also within 21 days — and that decision is final.
A council can also remove an existing landlord from the register mid-term if new adverse information comes to light. The same 21-day Sheriff Court appeal route applies.
Declared Letting Agents Are Tested Too
If you declare a letting agent on your application, that agent must also satisfy the fit-and-proper test. The agent must hold a valid Letting Agent Registration Number (LARN) on the Scottish Letting Agent Register. If your declared agent fails the test, your application can be refused — even if your own record is clean.
Preparing for a Smooth Assessment
The best preparation is honest disclosure and current safety documentation. Have your Gas Safety certificate (CP12), EICR, interlinked fire alarm installation records, carbon monoxide detector confirmation, legionella risk assessment, and EPC ready before you submit. The Scotland landlord registration guide includes a pre-application audit checklist that maps every safety declaration to the supporting document you need, so nothing is missing when the council reviews your submission.
