Selective Licensing in Essex: Which Councils Require a Licence

Essex Has Multiple Active Licensing Schemes

Essex is not a single licensing area. The county is divided between unitary authorities (Thurrock, Southend-on-Sea) and two-tier districts under Essex County Council. Each council controls its own property licensing decisions independently, so a landlord with properties across Essex may face different licensing requirements at each address.

Here is a summary of the main schemes operating in Essex as of 2026. Always check the specific council's website for current status, as schemes can expire, be renewed, or face legal challenges.

Thurrock Council

Thurrock operates the most comprehensive licensing framework in Essex:

  • Selective licensing: 16 of 20 wards designated, in force from January 2026 through January 2031. Standard fee: £1,034.90 (Part A £236.98 + Part B £797.92). Higher rate for applications more than 12 weeks late: £1,767.40. A judicial review challenge was refused in March 2026
  • Additional HMO licensing: borough-wide across all 20 wards, in force from September 2025 through September 2030. Covers properties with 3–4 occupants from 2+ households sharing amenities
  • Mandatory HMO licensing: national scheme, applies borough-wide to properties with 5+ occupants from 2+ households

Four wards are exempt from selective licensing: Little Thurrock Blackshots, Orsett, Stifford Clays and The Homesteads. HMO licensing (both additional and mandatory) applies in all 20 wards regardless.

Basildon Borough Council

Basildon has been studying the feasibility of a selective licensing scheme, but no designation is currently in force. Mandatory HMO licensing still applies to qualifying HMOs.

Southend-on-Sea City Council

Southend's current selective licensing scheme covers designated neighbourhoods in Milton, Kursaal, Victoria and Chalkwell wards and expires on 30 November 2026. The council is consulting on a replacement, but has not made a final decision. As a unitary authority, Southend makes its own licensing decisions independently of Essex County Council.

Tendring District Council

Tendring's current council information describes mandatory HMO licensing. I could not verify a selective or additional licensing scheme in force there; check the district's current licensing information for your address.

Other Essex Districts

Councils including Colchester, Chelmsford, Braintree, Harlow and Castle Point have the power to introduce selective licensing but have not all chosen to exercise it. The decision depends on local evidence about housing conditions, antisocial behaviour, deprivation and crime in the private rented sector. Check with the individual council rather than assuming Essex-wide coverage.

Epping Forest District borders multiple London boroughs where licensing is common. Landlords near the boundary should verify which authority has jurisdiction over their specific property — council boundaries and borough boundaries occasionally create confusion for properties on border roads.

What Essex Landlords Should Know

Each council is independent. A licence in Thurrock does not cover a property in Basildon. Each property needs its own licence from its own council, with its own fees and conditions.

Fee structures differ. Thurrock's Part A/Part B split and Higher Rate structure is specific to Thurrock. Other Essex councils set their own fee levels, though all must comply with the Hemming v Westminster split-fee requirements.

Mandatory HMO licensing is everywhere. Regardless of which council area you are in, if a property has 5 or more occupants from 2 or more households sharing amenities, it needs a mandatory HMO licence. This is a national requirement under Part 2 of the Housing Act 2004 — no local designation needed.

Schemes expire and renew. A five-year selective licensing designation does not automatically renew. The council must consult again and make a fresh designation. If a scheme expires, the licensing duty in that area ends (though any licence already granted continues until its own expiry date).
