Student HMO Licence in Scotland: What Landlords Need to Know

Three students from more than two families sharing a flat in Edinburgh or Glasgow are enough to trigger mandatory HMO licensing under Part 5 of the Housing (Scotland) Act 2006. There is no blanket exemption for private student lets, and the threshold is lower than in England — three unrelated occupants, not five. Every academic year, landlords who assumed a joint tenancy agreement would sidestep licensing discover that it does not.

Why Student Lets Are Automatically HMOs

Section 125 of the 2006 Act defines a house in multiple occupation as living accommodation occupied by three or more persons who are not all members of the same family or of one or other of two families, sharing basic amenities. Section 125(4)(b) specifically treats accommodation occupied during term time by a full-time further or higher education student as their only or main residence, even if they have a family home elsewhere. A four-bedroom flat let to three second-year students from more than two families sharing a kitchen is an HMO from the day they move in.

A joint Private Residential Tenancy does not change the occupancy count. The licensing test looks at how many unrelated individuals live there, not how many names appear on the lease.

Edinburgh and Glasgow: Where Most Student HMOs Sit

Edinburgh and Glasgow between them hold the bulk of Scotland's purpose-built and converted student accommodation.

Edinburgh enforces an overprovision policy in high-density student areas such as Marchmont and Bruntsfield. If the concentration of licensed HMOs in a ward already exceeds the council's threshold, a new licence application can be refused on overprovision grounds under section 131A. Edinburgh also requires planning permission or a Certificate of Lawful Use or Development for properties meeting the three-person planning trigger — so you may need planning approval as well as an HMO licence before a single tenant moves in.

The 2026/27 Edinburgh HMO licensing fee for a three-occupant property is £164 for a one-year licence or £424 for three years, following the council's 35% fee reduction from April 2026.

Glasgow charges significantly more. A new three-year licence for up to ten occupants costs £2,452, or £1,226 on renewal. Glasgow cross-checks HMO applications against the planning register and will refer any property without established planning consent to the Licensing and Regulatory Committee.

The Summer Vacancy Trap

Many student lets sit empty over summer. The HMO licence still applies for the full licence term. Letting tenants leave and then re-occupying the property with three new students in September does not reset the licensing requirement. If you allow the licence to lapse during a void period and then re-let, you are operating unlawfully — the maximum fine is £50,000 on summary conviction.

A timely renewal application under section 135 keeps the existing licence in force until the council determines the renewal. Missing the renewal deadline forces a new application, which subjects the property to current building standards and removes any grandfathered structural exemptions.

Documents You Will Need

Student HMOs require the same compliance bundle as any other:

  • Gas safety certificate (annual, Gas Safe engineer)
  • EICR (five-year, NICEIC or SELECT registered)
  • PAT testing (annual)
  • Fire risk assessment (reviewed annually)
  • Dimensioned floor plans (1:50 or 1:100 scale)
  • Public liability insurance (minimum £5 million)
  • Style PRT agreement

Edinburgh and Glasgow also expect proof that you hold valid Landlord Registration on the Scottish Landlord Register. If you already have an HMO licence, the council can passport your fit-and-proper status to the register at no extra charge.

Deposits and Tenancy Rules

All student PRT deposits must go into an approved Scottish tenancy deposit scheme — SafeDeposits Scotland, mydeposits Scotland, or Letting Protection Service Scotland — within 30 working days. This applies even for short academic-year lets. Getting the deposit wrong does not affect your HMO licence directly, but a First-tier Tribunal claim adds cost and distraction during an already tight turnaround.

What This Means for Your Licence Application

If you are letting to students for the first time, do not let the HMO operate solely on the basis of a pending first application. A council may grant a temporary exemption order under section 142 only while the owner takes specified steps to stop the property being an HMO that requires a licence. Separately, a timely renewal application carries the existing licence forward under section 135.
