Sunderland HMO Article 4 Wards: Millfield, Hendon, St Peters, Barnes and St Michaels
Sunderland's Article 4 Direction doesn't cover the whole city. It targets five specific wards where HMO concentrations were highest when the Direction took effect on 16 December 2013. If you're buying or converting a property in any of these areas, the planning rules are stricter than in the rest of Sunderland.
The Five Article 4 Wards
Millfield sits directly south of the city centre and has the highest concentration of shared houses in Sunderland. Its proximity to the University of Sunderland's City Campus makes it a primary student rental area. HMO density in parts of Millfield already meets or exceeds the council's 10% threshold within a 100-metre radius, which means new planning applications for HMO conversion face a steep uphill battle.
Hendon covers the area east of the city centre towards the coast. Like Millfield, it has historically high numbers of shared properties. Landlords in Hendon face the same dual requirement: mandatory HMO licensing for five-plus-person properties and planning permission for any C3-to-C4 conversion.
St Peter's includes the area around the University of Sunderland's Sir Tom Cowie Campus. Student-focused HMOs are concentrated here, and the ward's proximity to the campus means shared accommodation demand remains constant. The density rule is a particular obstacle — many streets in St Peter's have already passed the 10% HMO concentration that triggers refusal.
Barnes covers a residential area west of the city centre. It's less densely packed with HMOs than Millfield or St Peter's, which may make new planning applications more viable — but the Article 4 Direction still applies, so permitted development rights for C3-to-C4 conversion are withdrawn.
St Michael's sits between Millfield and Barnes. The ward has a mix of family housing and shared properties, and the Article 4 restriction covers it entirely.
What the Direction Changes
In these five wards, converting a family home (Class C3) to a small HMO for 3–6 unrelated occupants (Class C4) requires full planning permission. Everywhere else in Sunderland, that same conversion is permitted development under Class L of the General Permitted Development Order — no application needed.
Large HMOs (seven or more unrelated occupants, classified as sui generis) require planning permission everywhere in Sunderland regardless of ward.
The Density Test
Even if your property is in an Article 4 ward and you submit a planning application, approval is not guaranteed. The council's Policy H6 imposes a density test: if HMOs already account for more than 10% of residential properties within a 100-metre radius of the site, the application is likely to be refused. The "sandwich" rule — where a residential property would be flanked by HMOs on both sides — also triggers refusal.
This test is applied using the council's licensing register data and local knowledge. You can check the existing HMO register at City Hall (free in person) or request an electronic copy for £80.

Planning vs Licensing
The licensing and planning departments operate independently. You can apply for and receive a mandatory HMO licence without planning permission — the licensing team assesses housing standards, not planning status. But the planning department can still take enforcement action, and the licensing team may issue a restricted 12-month licence instead of the standard five-year term if it becomes aware that planning permission is missing.
Get planning sorted before you apply for the licence. If you've been operating a property as an HMO without required planning permission, contact the council's planning department about the route to regularise the planning position.
The Sunderland Landlord Licensing Guide walks through the planning and licensing interaction for each ward, including the density check and the consequences of proceeding without planning consent.
