Sunderland HMO Licence Conditions: What Your Licence Requires You to Do

Your Sunderland HMO licence isn't just permission to let a shared property. It's a binding document with conditions attached — and breaching any of them carries civil penalties of up to £40,000 per breach.

National Statutory Conditions

Every mandatory HMO licence in England includes conditions prescribed by Schedule 4 of the Housing Act 2004 and the Licensing of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018. These aren't optional extras the council chooses to add — they're baked into every licence automatically.

Maximum occupancy: Your licence specifies the maximum number of people permitted in the property and in each individual bedroom. Let more people in than the licence allows and you're in breach.

Gas safety: Produce a valid annual gas safety certificate to the council every year. Not "have one available if asked" — actively submit it.

Electrical safety: Keep the electrical installation in a safe condition, with a satisfactory EICR on file.

Smoke alarms: Working smoke alarms on every storey of the property. The council can demand a self-declaration of safety at any time.

Carbon monoxide alarms: Installed in any room used as living accommodation that contains a fixed combustion appliance, except a gas cooker.

Waste management instructions: Provide every tenant with clear written instructions on waste storage and disposal — bin collection days, container sorting, and bulk waste arrangements — in line with Sunderland Council's collection protocols. You must also provide suitable bins and storage facilities at the start of each tenancy.

Room sizes: No bedroom below 6.51 m² for a single adult, 10.22 m² for two adults, or 4.64 m² for a child under 10. Any room below 4.64 m² is prohibited as sleeping accommodation entirely. Ceiling space below 1.5 metres doesn't count toward the floor area.

Management Regulations

Separate from the licence conditions, all HMOs in Sunderland — including unlicensed three-or-four-person properties — must comply with the Management of Houses in Multiple Occupation (England) Regulations 2006. These impose ongoing duties:

  • Keep fire escapes clear and fire alarm equipment in working order
  • Maintain water supply, drainage, gas, and electrical systems in safe condition
  • Keep common parts, staircases, and shared amenities clean and safe
  • Display the manager's name, address, and telephone number prominently in the common areas

Changing the Licence Holder or Manager

An HMO licence is granted to a specific person or entity for a specific property and cannot be transferred. Notify Sunderland City Council immediately if the managing agent changes, and submit a formal variation through the portal. If ownership changes, the new owner must apply for a new licence.

The council's 2026/27 HMO fee schedule does not list a separate price for licence variations. Confirm any variation charge with the Licensing Team before submitting a change.

If the property is sold, the licence doesn't transfer. The new owner needs to submit a fresh application and pay the full new-application fee.

Anti-Social Behaviour Plans

Sunderland City Council expects licence holders to maintain an anti-social behaviour management plan. This doesn't mean you're responsible for every noise complaint — but you need a documented procedure for how you'll respond to reports of anti-social behaviour from your tenants. The plan should cover:

  • How tenants are made aware of their obligations
  • Your contact details and response process
  • How you escalate persistent issues
  • Record-keeping of complaints received and actions taken

The council may request evidence of this plan during inspections or as part of licence condition monitoring.

Temporary and Shortened Licences

Standard HMO licences in Sunderland can run for up to five years. If a property lacks required planning permission, the council may grant a restricted shorter-term licence, such as 12 months, to allow the owner to regularise the planning position. Check the proposed term and conditions in the draft licence.

The Sunderland Landlord Licensing Guide maps every condition to its practical compliance requirement, with tracker worksheets for ongoing duties like gas certificate renewals, waste instruction logs, and inspection preparation.
