Taking Over Deposit Protection from a Letting Agent in Northern Ireland
The Handover Problem
When a landlord in Northern Ireland ends a relationship with a letting agent and takes over self-management, confirm with the scheme that the deposit remains protected and update the scheme record so the landlord can manage it. The deposit may be recorded under the agent's account with TDS Northern Ireland or mydeposits Northern Ireland.
This is one of the most common compliance gaps for self-managing landlords. The agent leaves, the landlord assumes everything is sorted, and months later a tenant queries their deposit status or a council inspection reveals that the scheme record still names a defunct agency.
Before the Agent Leaves: What to Verify
Request the following from your letting agent in writing before the handover date:
1. The Deposit Protection Certificate. This confirms which scheme holds the deposit, the deposit reference number, the amount protected, and the date protection started. If the agent cannot produce this, ask the scheme directly to confirm whether the deposit is protected.
2. The prescribed information served on the tenant. You need a copy of the statutory prescribed information that was served within 35 days of the deposit being received, including the tenant's signed acknowledgement. Under the Private Tenancies (NI) Order 2006 (Schedule 1 of the 2012 Regulations), this document must name the scheme, the landlord or agent's contact details, the circumstances for deductions, and the dispute resolution process.
3. A scheme transfer instruction. If the deposit was protected under the agent's account, contact the scheme to transfer or update the deposit record. The process depends on the scheme — TDS NI and mydeposits NI each have their own procedures.
4. The actual deposit funds (insured scheme only). Under an insured scheme, the agent holds the deposit money in their client account. At handover, the agent must transfer the funds to you. Under a custodial scheme, the scheme itself holds the money, and the transfer is administrative rather than financial.
How to Transfer the Protection
If the agent used an insured scheme: The agent holds the deposit funds, so agree how those funds will be transferred to you and ask the scheme how to update its record. If the deposit remains protected and no new deposit money is received, the original 28-day and 35-day clocks do not restart when management changes.
If the agent used a custodial scheme: Contact the scheme operator (TDS NI or mydeposits NI) to ask how to update who manages the deposit record. The scheme holds the funds, and its customer service team can walk you through the applicable process.
In both cases, update the relevant scheme and landlord/agent contact details and provide the tenant with the current prescribed information. Keep proof of service.

What If the Agent Never Protected the Deposit
If you discover during the handover that the deposit was never protected, it remains out of compliance. Under the PTA 2022, failure to protect a deposit is a continuing offence until remedied.
Protect the deposit immediately in an approved scheme and serve the prescribed information. The statutory clocks run from receipt of deposit money, not from the management handover. If the agent failed to follow your instructions, consult a solicitor about any contractual remedies.
Do not wait to resolve the agent dispute before protecting the deposit. Every day of delay adds to the continuing offence.
Common Mistakes at Handover
Assuming the agent handled everything correctly. Verify directly with the scheme that the deposit exists and remains active.
Letting the protection lapse during the transition. If there is any gap between the agent's protection ending and yours starting, the deposit is unprotected during that window. Plan the transfer so the new protection starts before or on the same day the old one ends.
Not serving fresh prescribed information. Even if the agent served it correctly at the start of the tenancy, the change of managing party means the tenant needs updated contact details and potentially a new scheme leaflet.
The Tenancy Deposits in Northern Ireland guide covers the full agent-to-self-management handover process, including a delivery record template for proving you served updated prescribed information on the tenant after the switch.
