Thurrock Letting Agent Licensing: Can Your Agent Apply for You?

Agents Can Be Licence Holders

Under the Housing Act 2004, the licence holder must be the "most appropriate person" to hold the licence — someone who exercises day-to-day management control over the property, can start and end tenancies, access all parts of the building and authorise spending on repairs.

For self-managing landlords, that person is you. But if you use a letting agent who handles tenant management, rent collection and maintenance, the agent can be named as the licence holder on the application.

This is particularly relevant for overseas landlords. Thurrock Council will not issue a property licence directly to someone living outside the United Kingdom. If you are based abroad, you must appoint a UK-based managing agent as the licence holder.

The Owner's Liability Does Not Disappear

Naming your agent as licence holder shifts the day-to-day compliance obligations onto them, but it does not remove your legal exposure entirely. If the agent fails to comply with licence conditions and the property ends up unlicensed or in breach, enforcement action can reach the property owner as well as the agent.

In practice, this means you need to choose an agent who actually understands Thurrock's licensing requirements and will maintain compliance throughout the five-year term — not just submit the initial application and forget about it.

How Agent Applications Work

The process is the same as for a self-managing landlord. The agent logs into Thurrock Council's online portal, enters the property details, declares themselves as the proposed licence holder, provides their own fit-and-proper declarations and uploads the required documents. The property owner is listed as an interested party and receives consultation notifications.

The agent must pass the same fit-and-proper test, which considers any relevant criminal convictions, housing law breaches and discrimination findings. They must have the authority to manage the property and authorise expenditure.

Corporate Agents

If the managing agent is a limited company, Thurrock only accepts applications from UK-registered companies with an active Companies House office. A listed company director must be named as the designated licence holder. The licence is tied to that individual — if they leave the company, the council must be notified and a variation may be needed.

The Cost Question

Using an agent to handle the licensing application is convenient but adds to the cost. Local letting agencies and specialised compliance firms in Essex typically charge £250 to £500+ per property for application handling, on top of the council's licence fee. Many also require full property management agreements with ongoing monthly commissions of 10–15% of rental income.

For landlords who want to save that cost, the alternative is to handle the application yourself. The process is not technically difficult — it is mostly document assembly and form-filling — but it requires getting the details right the first time to avoid invalid application fees and processing delays.
