Victorian Rental Non-Compliance Register: How Landlords Get Listed and How to Avoid It

Victoria doesn't require a licence to be a private landlord. Instead, the accountability mechanism is public: the Victorian Rental Non-Compliance Register, maintained by Consumer Affairs Victoria (CAV), lists rental providers and estate agents who have failed to comply with a VCAT order or have been convicted of an offence under the RTA. The register is searchable by prospective renters and agents.

What Triggers a Listing

Two categories land a landlord on the register:

Failure to comply with a VCAT order. If VCAT orders you to pay compensation, return a bond, make repairs, or take any other specific action — and you don't — CAV can list you. The order must have been issued and not complied with within the specified timeframe.

Conviction for an offence under the RTA. A court conviction for any offence under the Residential Tenancies Act 1997 triggers eligibility for the register. Common bond-related offences include:

  • Late bond lodgement (section 406 — failure to lodge with the RTBA within 10 business days)
  • Collecting an excessive bond (section 31 — exceeding the one-calendar-month cap for properties at $900/week or less)
  • Charging prohibited fees (holding deposits, application fees, third-party platform fees charged to renters)

Administrative infringement notices from CAV don't automatically result in a register listing — it's the escalation to court conviction or an unremedied VCAT order that triggers it.

What the Listing Looks Like

The register is publicly accessible through the Consumer Affairs Victoria website and records non-compliance covered by the register.

For a self-managing landlord with one or two properties, a register listing is primarily a reputational issue. Prospective renters who check the register before signing a lease might choose a different property. Real estate agents considering management agreements might factor it in.

How Bond Mismanagement Leads to Listings

The most common bond-related pathway to the register:

  1. A renter complains to CAV about a missing bond lodgement or an over-collected amount
  2. CAV's Renting Taskforce may investigate the complaint
  3. If the landlord is convicted of an RTA offence, the conviction is a register listing ground
  4. Separately, failure to comply with a VCAT order (for example, an order to return the bond) is another listing ground

The parallel pathway involves VCAT directly: a renter takes a bond dispute to tribunal, VCAT orders the landlord to pay, and the landlord doesn't comply within the ordered timeframe.

How to Stay Off It

The register is designed to catch landlords who either don't know the rules or don't follow tribunal orders. Both are avoidable:

Meet every statutory deadline. Lodge the bond within 10 business days. Deliver the condition report before move-in. Provide evidence at least 3 business days before filing a bond claim. Respond to renter-initiated claims within 14 calendar days of RTBA notice (20 calendar days if served by post).

Don't over-collect. Calculate the bond cap correctly — weekly rent × 52 ÷ 12, not weekly rent × 4. The difference can be hundreds of dollars, and the RTBA portal flags over-collection.

Comply with VCAT orders promptly. If VCAT orders you to return part of the bond or pay compensation, do it within the specified timeframe. Ignoring an order doesn't make it go away — it creates a separate non-compliance ground.

Keep records. Dated lodgement confirmations, signed condition reports, pre-claim evidence delivery receipts. If CAV investigates, your compliance record is your defence.

The Victoria Rental Bond guide walks through every compliance obligation with a dated audit trail, so nothing gets missed across the tenancy lifecycle.
