WA Tenancy Legal Advice for Landlords: Where to Get Help

Finding legal advice as a landlord in Western Australia is harder than it should be. Most of the free services — the ones that come up first in a search — are built for tenants. If you are a self-managing landlord trying to end a tenancy and need help beyond what the government website provides, here is what is actually available to you.

Consumer Protection WA — General Information (Not Legal Advice)

The Consumer Protection advice line (1300 30 40 54) is the first port of call for most landlords. It provides general information about the Residential Tenancies Act 1987 — which form to use, what the notice periods are, how the breach process works.

What it does not do is give legal advice. The staff cannot tell you whether your specific notice is valid, whether your particular situation qualifies under Section 63 or Section 64, or how to handle a complication the legislation does not address cleanly. It is information, not advice. For an interpreter, call TIS National on 13 14 50 and ask to be connected.

Circle Green Community Legal — Tenant-Facing Only

Circle Green Community Legal (formerly Tenancy WA) is the main specialist tenancy legal service in Western Australia. It provides legal advice, advocacy, and representation — but exclusively for tenants.

Circle Green does not assist landlords. If you call as a landlord, you will be directed back to Consumer Protection. This is not an oversight — community legal centres are funded to serve tenants, who are the parties most likely to be unrepresented and facing eviction.

Legal Aid WA — Limited Landlord Coverage

Legal Aid WA provides general legal guidance and referrals. For residential tenancy matters, it does not typically offer direct representation to landlords in standard disputes. Its tenancy resources are primarily aimed at tenants.

Legal Aid can provide general information and referrals to private practitioners if your matter is complex.

Private Solicitors — Your Main Option

For personalised legal advice on ending a tenancy — reviewing your notice, advising on a disputed termination, or representing you at the Magistrates Court — a private solicitor is the realistic option for landlords. Rates in Perth typically start at $300 per hour and above.

Legal representation at Magistrates Court tenancy hearings is restricted under the RTA. A party generally appears in person unless a statutory exception applies, including where all parties and the Magistrate consent, the other party is a legal practitioner, the applicant is a corporate entity, a party cannot properly conduct the case because of disability or incapacity, or the Commissioner for Consumer Protection appears for a party. In practice, if the matter is straightforward (valid notice, clean service, clear ground), self-representation is common.

The Law Society of Western Australia

If you need to find a solicitor with tenancy experience, use the Law Society of Western Australia's Find a Lawyer search tool to look for practitioners by area of law and location.

What Most Landlords Actually Need

Most tenancy termination matters in WA do not require a solicitor. They require procedural precision — the right form, the right section, the right date-counting, the right service method. The Magistrates Court dismisses applications because the notice was technically defective, not because the landlord needed a lawyer to argue a difficult point of law.

The Ending a Tenancy in Western Australia guide provides the procedural framework that covers the gap between Consumer Protection's general information and a solicitor's personalised advice — every form, every ground, every date-counting rule for a self-managing landlord ending a tenancy.
