Wales Landlord EPC and MEES Requirements

The Minimum Standard: EPC Band E

Under the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015, you cannot grant a new occupation contract or continue letting a domestic property in Wales if its Energy Performance Certificate falls below Band E, unless a valid exemption applies. The EPC is valid for 10 years from its date of issue.

You must also serve the EPC on the contract-holder before they take occupation. Under Schedule 9A to the Renting Homes (Wales) Act 2016, a landlord who has not provided a valid EPC cannot serve a Section 173 no-fault possession notice — the same block that applies to missing electrical reports, gas safety records, and written statements.

What If Your Property Is Band F or G?

If your property cannot reach Band E, you must follow the exemption pathway before you can legally continue letting:

Step 1: Assess which qualifying energy efficiency measures could improve the rating — cavity wall insulation, loft insulation, boiler upgrade, double glazing, or other measures recommended on the EPC itself.

Step 2: Attempt to implement those measures, either through available grant funding or self-funding up to the statutory spending cap of £3,500 (inclusive of VAT).

Step 3: If the property still does not reach Band E after spending up to £3,500, or if you cannot install the measures because a third party refuses consent, register a formal exemption on the PRS Exemptions Register.

The main exemption categories:

Exemption What you need to prove How long it lasts
High Cost Cap (£3,500) Three written quotes showing the cheapest qualifying measure exceeds £3,500 inc. VAT 5 years
Consent Refused Written refusal from the contract-holder, planning authority, or superior landlord 5 years
Wall Insulation Qualified professional's certification that wall insulation would cause structural damage 5 years
Property Devaluation Surveyor report showing works would reduce market value by over 5% 5 years
New Landlord Proof of a qualifying recent-landlord circumstance, such as a lease granted by court order or a qualifying purchase of an already-let property 6 months (grace period)

Every exemption expires on a change of property ownership. If you sell the property, the new owner starts fresh and cannot rely on your exemption registration.

MEES Exemption Does Not Equal Fitness Compliance

This is the critical distinction that catches landlords out. Registering a MEES exemption under the 2015 Regulations does not exempt you from your Section 91 fitness duty under the Renting Homes (Wales) Act 2016.

If your Band F or G property exposes the contract-holder to Hazard 2 (Excess Cold) from the 29 statutory matters — because the heating system cannot maintain 18°C, or because absent insulation creates cold surfaces and condensation — the property is unfit for human habitation as a matter of civil law. That is true even though you hold a valid exemption on the PRS Exemptions Register.

The MEES exemption protects you from the administrative penalty for letting below Band E. It does not protect you from the section 91 rent consequence or Section 173 restrictions that may arise if the dwelling is objectively unfit. Unfitness alone does not create a Welsh RRO; an RRO is a separate remedy for qualifying Rent Smart Wales licensing offences.

Practical Steps for Welsh Landlords

  1. Check your current EPC — look it up on the national EPC Register. If it has expired or your property is below Band E, act before your next occupation contract.
  2. Commission a new EPC if needed — an accredited Domestic Energy Assessor produces the certificate and the recommendations report. Typical cost: £60–£100.
  3. Review the recommendations — the EPC includes a list of improvements with estimated costs and the new rating each would achieve. Target the measures that move you to Band E for the least cost.
  4. Serve the EPC before move-in — not within 14 days after, but before the contract-holder takes occupation. If you cannot provide it on signing day, arrange for it to be in the contract-holder's hands before they collect the keys.
  5. File it in your compliance folder — the EPC serial number, the date served, and the delivery method go into your document service log alongside the EICR, gas safety record, and written statement.

The Fitness for Human Habitation compliance guide includes a Section 173 Readiness Audit that cross-checks all seven required documents — including the EPC — against their service deadlines, so nothing blocks your possession right by accident.
