Wandsworth Unlicensed Property Penalties: Fines, Rent Repayment Orders and Enforcement

The Offence

Operating a privately rented property without the required licence in Wandsworth is a criminal offence. For HMOs, it falls under Section 72 of the Housing Act 2004. For properties in selective licensing wards, it's Section 95. Breaching a licence condition is a separate offence in its own right.

The council's Private Sector Housing Enforcement Policy gives them several tools, and they can use more than one at a time.

Civil Financial Penalties

As an alternative to criminal prosecution, Wandsworth can impose civil financial penalties under Section 249A of the Housing Act 2004. For offences committed on or after 1 May 2026, the maximum is £40,000 per offence; for offences committed before that date, it was £30,000.

Each breached licence condition counts as a separate offence with its own penalty. A landlord running an unlicensed HMO with three breached conditions could theoretically face four penalties — one for operating without a licence and one for each condition breach.

Criminal Prosecution

If the council chooses prosecution over civil penalties, a summary conviction in the Magistrates' Court carries an unlimited fine. The council typically reserves prosecution for persistent offenders, serious hazards, or landlords who ignore civil penalty notices.

Rent Repayment Orders

Under Section 40 of the Housing and Planning Act 2016, tenants or the local authority can apply to the First-tier Tribunal for a Rent Repayment Order (RRO) against a landlord who has operated without a licence.

For licensing offences committed on or after 1 May 2026, an RRO can require you to repay up to two years' gross rent paid during the unlicensed period. For earlier offences, the maximum period was 12 months. Where rent was covered by Housing Benefit or Universal Credit, the tribunal orders repayment directly to Wandsworth Borough Council.

The council collaborates with specialist tenant advocacy organisations to support tenants in lodging these applications.

Interim Management Orders

Under Section 102 of the Housing Act 2004, if there's no reasonable prospect of an unlicensed property becoming licensed — or if serious health and safety risks exist — the council can make an Interim Management Order. This transfers management control and rent collection rights directly to Wandsworth Council for up to 12 months. You lose control of the property.

Banning Orders and the Rogue Landlord Database

Serious or repeated housing convictions can trigger an application for a Banning Order under Part 2 of the Housing and Planning Act 2016. A banning order prohibits you from letting property or engaging in letting agency work for a specified period.

Confirmed offences and civil penalties are recorded on the Greater London Authority's Rogue Landlord and Agent Checker — a public database that prospective tenants and agents can search.

The Section 21 Problem

The Renters' Rights Act 2025 abolished Section 21 no-fault notices for private rented tenancies from 1 May 2026. Before that change, operating without a required licence could prevent use of Section 21. Wandsworth says a valid licence application lets you legally let the property while the council processes it, but an application is not a possession notice or a guarantee of a licence.

How to Protect Yourself

If you're uncertain whether your property needs a licence, the Wandsworth Council address lookup tool confirms the ward and applicable scheme. If a licence is required and you haven't applied, the risk compounds every month.

The Wandsworth Landlord Licensing guide covers the complete application process from address verification through to licence grant, including the document checklist and fee calculator to help you apply correctly the first time.
