ACT Rental Minimum Standards — Compliance Guide for Landlords

Six government websites. Three different agencies. One deadline that won't move.

The ACT's minimum housing standard for ceiling insulation started phasing in on 1 April 2023. The final deadline — 30 November 2026 — applies to every continuously tenanted property under an agreement entered before 1 April 2023, including long-running periodic leases that have never been renewed. Miss it, and your tenant can take you to ACAT for a compliance order.

But ceiling insulation is only one piece. Your rental advertisement has to include an insulation disclosure statement. A licensed electrician has to inspect the roof space and issue the electrical work reports before an insulation installer can touch the batts. Smoke alarms have to be photoelectric, on every level, and tested before the tenant moves in. Strata unit owners still carry individual disclosure duties even when the Owners Corporation handles the building. And every document — the EER report, the installer receipt, the electrical work reports, the statutory declaration for an exemption — has to be the right document, filed in the right sequence.

The government portals explain what the law says. They don't tell you what to do first.

The ACT Compliance Sequencer

This guide is built around the order things actually have to happen — not the order the legislation presents them. We call it the Compliance Sequencer because the biggest mistakes landlords make aren't about ignorance; they're about sequence. Booking an insulation installer before your electrician signs off. Listing a property without the disclosure statement. Signing a new fixed-term lease without realising you've just triggered a 9-month compliance countdown.

The guide maps every step in the order it needs to happen, from the first property assessment through to the records you file after the work is done.

What's Inside

  • Property Assessment Matrix — build date, existing R-value, lease type, and strata status feed into a decision tree that tells you exactly where your property stands and what (if anything) needs to happen
  • Ceiling Insulation Standard Walkthrough — the R2 existing threshold, the R5 upgrade requirement, and the five exemption grounds (structural infeasibility, lower/middle-floor strata, heritage listing, Owners Corporation refusal, $10,000 cost cap), with the evidence each one needs
  • Two-Stage Contractor Protocol — the mandatory sequence of licensed electrician inspection (Required Electrical Work Report, then Completed Electrical Work Report) followed by an EEC-certified insulation installer, with credential verification steps and direct links to the Access Canberra public licensing register
  • Advertising Disclosure Rules — the four statements every listing must include on Allhomes, Realestate.com.au, or any other platform: fixed weekly rent, EER status, ceiling insulation compliance or exemption, and adaptable housing status
  • Pre-Tenancy Disclosure Checklist — EER report, insulation status statement, Unit Title Rental Certificate (strata only), pool safety and sustainability disclosures, and how to attach them to the tenancy agreement
  • Smoke Alarm and Safety Requirements — photoelectric standards under AS 3786, placement rules, landlord vs tenant battery duties under Standard Tenancy Terms Clause 63A, and what to check before the tenant moves in
  • 9-Month Window and 30 November 2026 Deadline — which trigger applies to your property, what happens when you miss the date, and the enforcement pathway through ACAT
  • ACAT Compliance Applications — what a tenant can apply for, the filing fees (from $93 for small claims under the 2026/27 determination), what ACAT typically orders, and how to respond
  • Sustainable Household Scheme — zero-interest government loans for ceiling insulation upgrades, eligibility, and how to apply
  • Seven printable worksheets — Pre-Listing Compliance Audit Worksheet, Insulation Decision Flowchart, Pre-Installation Electrical Safety Tracker, Trade Contractor Verification Log, Pre-Tenancy Documentation Checklist, Repair Response Log, and 12-Month Record Retention Register

Who It's For

This guide is for private landlords in the Australian Capital Territory who manage their own rental properties — whether that's a single house you used to live in, an investment unit in a strata complex, or a property you manage from interstate. It's written for people who want to handle compliance themselves without paying ongoing agency management fees, but who need a clear, dated reference that puts the steps in order.

Who It's Not For

If you're a tenant looking for advice on your rights, the Legal Aid ACT Tenants Advice Service is the right starting point — they provide free legal help to renters. If you need help ending a tenancy or managing a bond dispute, those are covered in separate guides. And if you're already in an active ACAT dispute over property standards, you need legal advice specific to your case, not a general compliance guide.

Why Not Just Use the Free Government Pages?

The ACT Government publishes authoritative information across the Housing portal, Climate Choices, Access Canberra, the Legislation Register, and ACAT's website. All of it is free and all of it is reliable. What it isn't is sequenced. The insulation standard is on one site. The electrical safety requirements are on another. The advertising disclosure rules are in a different section again. The exemption grounds are buried in the Regulation. And none of them give you a printable workflow you can follow from start to finish or a record-keeping template you can file with your property documents.

This guide doesn't replace those government sources — it cites them directly and links to them. What it adds is the structure: one document, one sequence, dated to the rules as at October 2026, with the worksheets to prove you followed it.
