Blackpool Selective Licence Conditions — What You Must Comply With

Mandatory Conditions (Statutory — Every Licence)

Schedule 4 of the Housing Act 2004 imposes conditions that must appear on every selective licence. These aren't optional extras — they're built in by law regardless of what the council's specific conditions document says.

Gas safety — If gas is installed, supply a current Gas Safety Certificate to the council annually. This means renewing it every 12 months and sending a copy, not just having one done once for the application.

Electrical safety — Keep all electrical installations in proper working order and safe for continued use, and keep landlord-supplied electrical appliances and furniture safe. Supply a declaration about their safety to the council on request.

Smoke alarms — Maintain working smoke alarms and supply a declaration of their positioning and functionality. For selective licences in Blackpool, the standard is mains-powered, interlinked smoke alarms on each level of the property.

Carbon monoxide detectors — Required in any room used wholly or partly as living accommodation that contains a fixed combustion appliance other than a gas cooker. These must be kept in working order throughout the tenancy.

Written tenancy terms — Supply occupants with a written statement of the terms they occupy the property under. A proper tenancy agreement, not a verbal arrangement.

Discretionary Conditions Specific to Blackpool

On top of the statutory conditions, Blackpool Council attaches its own discretionary conditions under Section 90 of the Housing Act 2004. These reflect the specific housing problems in the eight inner wards.

External property maintenance — The property's exterior, curtilage and any shared areas must be kept in reasonable condition. Peeling paint, damaged guttering and overgrown gardens are enforcement triggers.

Waste management — Provide adequate refuse containers and ensure curtilage areas stay free from accumulated waste. This one gets enforced visually — if a council officer drives past and sees bin bags piled in the front yard, that's a potential condition breach.

Antisocial behaviour management — Issue written ASB management procedures to tenants at the start of the tenancy. If the council receives noise or neighbourhood complaints about your property, you're expected to investigate, take reasonable steps and document what you did. "I told the tenant to keep it down" without a paper trail won't satisfy an inspector.

Tenancy references — Obtain references for prospective tenants before granting a tenancy. The council's aim is to reduce ASB in the designated wards, and this condition is part of that strategy.

Additional Conditions for HMO Licences

Mandatory HMO licences carry heavier conditions, including minimum sleeping room sizes (6.51 m² for one person, 10.22 m² for two) and specific amenity ratios. One bathroom can serve a maximum of five occupants. Kitchen facilities must scale with occupancy — worktop space, cooking rings, oven capacity and sink provision are all measured.

These amenity standards are enforced across the Blackpool, Fylde and Wyre area, not just within Blackpool's boundaries.

What a Condition Breach Costs

Breaching licence conditions is an offence under Section 95(2) of the Housing Act 2004. For an offence committed on or after 1 May 2026, the council can issue a civil penalty of up to £40,000; the maximum for an offence committed before that date was £30,000. For persistent or serious breaches, they can revoke the licence entirely, which puts you back in unlicensed-operator territory and opens the door to rent repayment order claims from tenants.

The practical advice: set up a calendar system for certificate renewals, keep written records of any ASB complaints and your response, and don't let external maintenance slide. Most condition breaches the council pursues are the obvious, visible ones.

The Blackpool Landlord Licensing Guide includes a compliance tracking register and certificate renewal calendar designed to keep you on top of conditions for the full five-year licence period.
