Deposit Protection Evidence and Proof of Delivery in Scotland

Lodging a deposit with an approved Scottish scheme and serving prescribed information are legal duties. Proving you did both — within 30 working days — is what actually protects you when a tenant applies to the First-tier Tribunal. The Tribunal does not assume compliance; the landlord carries the burden of demonstrating it, and undocumented compliance looks identical to non-compliance in a hearing.

Why an Evidence Trail Matters

Under Regulations 9 and 10 of the Tenancy Deposit Schemes (Scotland) Regulations 2011, the Tribunal must order a penalty of up to three times the deposit if it finds the landlord failed to lodge the deposit, missed the 30-working-day deadline, or did not deliver Regulation 42 prescribed information. The word "must" is important — the Tribunal has no discretion to issue a zero-penalty finding once a breach is proven.

That penalty framework makes the evidence question binary. Either you can demonstrate compliance with dates, receipts, and delivery confirmations, or you cannot. Landlords who lodge deposits on time but keep no proof of the service date for prescribed information are exposed to the same tribunal risk as landlords who never lodged at all.

The Three Evidence Points to Document

1. Deposit Receipt

When the tenant pays the deposit, record it immediately:

  • Date received (the date money actually cleared, not the date it was sent)
  • Amount
  • Payment method (bank transfer reference, debit card receipt, or for cash — a dated written receipt specifying the amount, property address, payer, and allocation)
  • Property address and tenancy start date

The tenancy start date is critical because Regulation 3(1) triggers the 30-working-day clock from the beginning of the tenancy, not from the date the deposit is received. If a tenant pays on 15 May for a tenancy starting 1 June, the clock begins on 1 June.

2. Scheme Lodging Confirmation

A landlord's internal bank transfer instruction to the scheme does not prove compliance. Under Regulations 16 and 22, the duty is fulfilled only when the scheme administrator issues formal written confirmation that the funds have been received and placed into a designated account.

All three approved schemes — SafeDeposits Scotland, MyDeposits Scotland, and Letting Protection Service Scotland — issue email or portal confirmations with a deposit reference number and the date of acceptance. Save these confirmations. They are the primary evidence that the deposit reached the scheme within the statutory window.

If the electronic transfer fails, the payment reference is incorrect, or the scheme cannot match the payment to a tenancy, the landlord remains legally non-compliant until the issue is resolved and the scheme confirms receipt.

3. Prescribed Information Delivery

Regulation 42 requires the landlord to provide a specific set of information to the tenant within the same 30-working-day window. Serving that information is only half the job — proving delivery is the other half.

Effective proof-of-delivery methods:

  • Email with read receipt or delivery confirmation — where the tenancy agreement contains explicit written consent for electronic notices, keep the sent email and any delivery/read confirmation
  • Signed acknowledgement — a simple form where the tenant signs and dates receipt of the prescribed information pack, with a copy retained by the landlord
  • Recorded delivery post — Royal Mail Signed For or Special Delivery, where the tracking record confirms the date the tenant received the envelope

What does not work as proof: handing a document to a tenant at a property viewing with no record, leaving papers inside the property for the tenant to find, or sending information by ordinary post with no tracking.

Building an Evidence Log

A deposit evidence log is not a legal requirement, but it consolidates the three evidence points into one document that can be produced quickly if a tribunal application arrives. A basic log records:

Field Detail
Tenant name(s) All named tenants on the PRT agreement
Property address Full address including postcode
Tenancy start date The date the PRT begins (Regulation 3 trigger)
Deposit amount Must not exceed two months' rent
Date deposit received When funds cleared
Payment method Transfer reference, receipt number, etc.
Scheme name SafeDeposits Scotland, MyDeposits Scotland, or LPS Scotland
Scheme reference number From the lodging confirmation
Date scheme confirmed receipt The confirmation email/portal date
Date prescribed info served When the Regulation 42 pack was delivered
Proof of delivery method Email confirmation, signed receipt, tracked post reference
Deadline (30 working days from tenancy start) Calculated excluding weekends and Scottish public holidays

Keep the log alongside copies of the scheme confirmation, the prescribed information document itself, and the delivery proof. If a tenant applies to the Tribunal under Rule 103, this file gives your response everything it needs.

The Timing Gap That Catches Landlords

The most common evidence failure is not a missing document — it is a missing date. A landlord lodges the deposit on day 28 but does not serve prescribed information until day 35, assuming the two tasks share one deadline. They do share the same 30-working-day deadline, but both must be completed within it. Serving prescribed information late — even with the deposit safely lodged — is a standalone breach that triggers the same penalty framework.

The evidence log forces the question: is each step completed and documented within the window?
