Do I Need a Landlord Licence in Gateshead?
If you rent out a property in Gateshead — or you are about to — the answer depends on two things: where the property is and who lives in it. Gateshead runs three separate licensing schemes, and the combination of your property's location and its occupancy structure determines whether you need a licence and which one.
Step 1: Check the Occupancy
Start with how many people live in the property and whether they form separate households.
People who are married, in a civil partnership, cohabiting, or related (parents, children, siblings, grandparents, aunts, uncles, nephews, nieces, cousins) form a single household. Everyone else — friends, colleagues, unrelated sharers — counts as a separate household.
Five or more occupants from two or more households → your property is a mandatory HMO. You need a mandatory HMO licence regardless of where in Gateshead it is. This is a national requirement, not a local scheme.
Three or four occupants from two or more households sharing amenities → your property is an HMO under the lower threshold. Whether you need a licence depends on location (Step 2).
One person, a couple, or a single family → your property is a standard let. Whether you need a licence depends on location (Step 2).
Step 2: Check the Location
Go to the Gateshead Council address checker at gateshead.gov.uk and enter your property's full address. The tool tells you whether the address falls within one of the 16 designated Lower Layer Super Output Areas (LSOAs).
If the answer is no — the property is outside all designated areas — and it is not a mandatory HMO, you do not need a licence.
If the answer is yes, you need either a selective licence or an additional HMO licence, depending on the occupancy from Step 1.
Step 3: Match Scheme to Property
Working top-down through the hierarchy:
- Mandatory HMO (5+ occupants, 2+ households): licence required, borough-wide. Displaces all other schemes.
- Additional HMO (3–4 occupants, 2+ households, in a designated LSOA): licence required under the additional scheme. Displaces the selective licence.
- Selective (single person, couple, or family let in a designated LSOA): licence required under selective licensing.
- No licence needed: property is outside designated areas and below the mandatory HMO threshold.
A property can only hold one licence at a time. The higher-tier scheme always takes priority.

Common Scenarios That Trip Landlords Up
The Tyneside flat: a self-contained flat let to one family needs a selective licence (if in a designated LSOA). Letting both flats in a converted building to unrelated households does not by itself make the building a standard HMO. If the block meets the section 257 statutory tests and is within one of the 16 designated LSOAs, it is covered by additional HMO licensing; each privately let flat may also need a selective licence if its address is in a selective area.
The three-nurse house: three unrelated healthcare workers sharing a house form three separate households. That is an additional HMO, not a selective licence — even though three people feels too small for an HMO.
The property on the boundary: LSOA borders can split a single street. Your neighbour's property might not need a licence while yours does. Only the council's address checker settles it — postcode alone is not enough.
What If You Are Not Sure
If the occupancy is borderline or the address checker gives an unclear result, contact the Private Sector Housing Team at Gateshead Council (0191 433 3926 or [email protected]). A refused application leaves Part A with the council; Gateshead provides full refunds for applications submitted in error, such as duplicate applications or properties outside the scheme. If you selected the wrong licence category, ask the council before paying for another application.
