Do I Need a Landlord Licence in Blackpool

Start With the Occupancy Test

Before you check wards or maps, count the people living in the property and work out how many separate households they form.

If the property is occupied by five or more people in two or more separate households and meets one of the mandatory HMO tests under section 254 of the Housing Act 2004, it requires a mandatory HMO licence regardless of where in Blackpool it sits — all 21 wards, not just the inner eight. Sharing a basic amenity is the standard test; certain self-contained-flat and converted-building HMOs can also qualify. Mandatory HMO licensing is a national statutory duty with no expiry date.

If the property is let to a single household, a couple, individual sharers, or fewer than five people, move to the next step.

Check the Address Against the Designation Boundary

Blackpool's Inner Area Selective Licensing Scheme covers eight specific wards: Bloomfield, Brunswick, Claremont, Talbot, Tyldesley, Victoria, Warbreck and Waterloo. The scheme runs from 1 April 2025 to 31 March 2030.

To check whether your property is inside those boundaries, use the scheme checker on Blackpool Council's self-service portal at selfservice.blackpool.gov.uk. Enter the property's postcode; if the result is unclear for a specific flat, contact the Housing Licensing Team with the full address.

Don't rely on postcodes alone — ward boundaries were redrawn and a postcode can straddle two wards. Streets bordering Layton, Park or Hawes Side frequently catch landlords out. If you're on a boundary, email [email protected] for written confirmation.

The Decision Logic

Here's the short version:

  1. Five or more occupants, two or more households, and one of the statutory HMO tests is met → mandatory HMO licence (borough-wide)
  2. Any other privately rented property in one of the eight inner wards → selective licence required, unless a statutory exemption applies
  3. Any other privately rented property outside the eight wards → no Blackpool selective licence required

Blackpool does not operate an additional HMO licensing scheme. That means a three-person or four-person shared house inside the eight inner wards needs a selective licence, while the same property in an outer ward needs no licence at all (unless it triggers mandatory HMO thresholds).

Exemptions Worth Knowing

Even inside the eight designated wards, certain properties are exempt from selective licensing:

  • Properties let under a tenancy or licence granted by a body registered as a social landlord
  • Premises with a current temporary exemption notice (TEN)
  • A tenant or licensee who shares an amenity with the landlord or a member of the landlord's family
  • A family-member tenancy or licence where the grantor is the freeholder or holds a lease of more than 21 years that cannot be ended early other than by forfeiture, and the family member occupies the property as their only or main home
  • Holiday homes, and student buildings occupied solely or mainly by people on full-time further or higher-education courses where either the educational establishment is specified in regulations and manages or controls the building, or a person specified in regulations manages or controls it

What Happens If You Need One and Don't Apply

The penalties are steep. For a licensing offence committed on or after 1 May 2026, Blackpool Council can issue a civil financial penalty of up to £40,000 as an alternative to criminal prosecution; the maximum for an offence committed before that date was £30,000. For offences committed on or after 1 May 2026, tenants can apply for rent repayment orders covering up to 24 months' rent. Being unlicensed does not itself prevent a landlord from relying on an otherwise available Section 8 ground. Ground 6B may apply in specified cases, including when the council refuses a required licence or revokes one.

The one protection: if you submit a duly made application (all documents uploaded, Part 1 fee paid), you gain statutory defence against prosecution while the council processes it. An incomplete submission or a saved draft does not count.
