Do I Need a Property Licence in Waltham Forest?

The Three Questions That Decide

Whether your Waltham Forest rental needs a licence — and which type — comes down to three things: how many people live there, how many separate households they form, and which ward the property sits in.

5 or more occupants from 2 or more households sharing basic amenities → Mandatory HMO licence (all 22 wards)

3 or 4 occupants from 2 or more households sharing basic amenities → Additional HMO licence (all 22 wards)

Single person, family, or up to 2 unrelated sharers → Selective licence (20 of 22 wards)

The two wards excluded from selective licensing are Hatch Lane & Highams Park North and Endlebury. A standard single-family let in those wards does not need a licence. But when three or more occupants from two or more households share basic amenities, HMO licensing applies borough-wide.

What Counts as a "Household"

Under Section 258 of the Housing Act 2004, a household is members of the same family — spouses, cohabitees, parents, grandparents, children, grandchildren, siblings, aunts, uncles, nephews, nieces, and foster relationships.

Unrelated individuals form separate households. Three friends sharing a house create three households, making it a licensable HMO. A couple and a lodger create two households — but if they share basic amenities, the three occupants make it an additional HMO requiring a licence borough-wide.

Children count as occupiers for threshold calculations.

Common Scenarios

A couple in a flat in Leytonstone: One household, two occupants. Leytonstone is a designated ward. → Selective licence needed.

Three professionals sharing a house in Chingford: Three households, three occupants. → Additional HMO licence needed (borough-wide scheme).

A family of four in Endlebury: One household. Endlebury is excluded from selective licensing. → No licence needed.

A landlord letting rooms to five students sharing basic amenities in Walthamstow: Five households, five occupants. → Mandatory HMO licence needed.

Converted Flats and Section 257

If your property is a converted block of flats where the conversion didn't comply with the Building Regulations 1991 and fewer than two-thirds of the self-contained flats are owner-occupied, the whole building may be classed as a Section 257 HMO under the Housing Act 2004. Waltham Forest excludes Section 257 blocks from its additional HMO licensing scheme — but individual flats within the block are still licensed based on their own tenancy structure.

A single-family flat in a Section 257 block in a designated ward needs a selective licence. A flat within the same block housing three unrelated sharers who share basic amenities needs an additional HMO licence.

How to Check

Enter your property's postcode on the council's property licensing portal at propertylicensing.walthamforest.gov.uk. The system confirms the ward and applicable scheme. Then count your occupants and households.

If you're unsure about borderline cases — a lodger arrangement, a converted flat, a property that changed occupancy since the scheme started — the Waltham Forest Landlord Licensing Guide includes a step-by-step decision framework covering every combination of occupant count, household structure, and ward location.
