Do I Need a Property Licence in Newham?
If you rent out a property anywhere in the London Borough of Newham, the short answer is almost certainly yes — you need a property licence. Newham is one of the few boroughs where virtually every rented home requires one. But which licence depends on your property's location, who lives there, and how many of them there are.
The Three-Step Decision
Step 1: Check the ward. Enter your property's postcode on Newham's licensing portal to confirm which ward it falls in. Two wards — Royal Victoria and Stratford Olympic Park — are excluded from Selective and Additional HMO licensing. Properties in those two wards only need a licence if they qualify as a Mandatory HMO (five or more people from two or more households). If your property is in any of the other 21 wards, keep going.
Step 2: Count the people and households. A "household" under the Housing Act 2004 means members of the same family. Unrelated individuals, even if they share a tenancy, each count as a separate household.
Step 3: Match to a scheme.
| Who lives there | Households | Licence needed (21 wards) |
|---|---|---|
| Single person, couple, or family | 1 | Selective Licence |
| 2 unrelated sharers | 2 | Selective Licence |
| 3-4 people from 2+ households | 2+ | Additional HMO Licence |
| 5+ people from 2+ households | 2+ | Mandatory HMO Licence |
Properties in Royal Victoria or Stratford Olympic Park with fewer than five people from two or more households are exempt — no licence required.
Inherited Properties
If you've inherited a rented property in Newham, check whether it has a current licence. Property licences are non-transferable between persons — a change of licence holder requires a new application with the applicable fee.
If the property is being let without a licence, do not assume an application made by a previous owner covers you. A statutory defence while an application is pending depends on a duly made application with the required information, documents, and fee.
Accidental Landlords
Moved out of your Newham home and rented it to cover the mortgage? You're an accidental landlord, and the licensing rules apply fully. There's no exemption for homeowners who didn't intend to become landlords.
The same applies if you're temporarily working abroad. An overseas landlord can hold a licence, but Newham requires either UK residency or a formally designated UK-based managing agent who has full operational, legal, and financial control of the property.

Buy-to-Let Investors
A property bought specifically to let is no different in licensing terms. Whether it's your first investment or your twentieth, the ward and occupancy test determines the licence type. Portfolio landlords with multiple properties in the same building may qualify for the multi-dwelling discount (£700 instead of £750 for second and subsequent selective licences applied for simultaneously).
Properties That Don't Need a Licence
A handful of statutory exemptions apply regardless of ward:
- Social housing managed by registered providers or housing associations
- Resident landlords living in the property as their main home with up to two lodgers (three or more lodgers pushes into HMO licensing)
- Holiday lettings exclusively for short-stay guests
- Business tenancies under Part II of the Landlord and Tenant Act 1954
- Properties occupied solely by close family with no commercial rent
If you believe an exemption applies, keep records — the burden of proof falls on the owner if the council challenges the property's unlicensed status.
The Cost of Getting It Wrong
Letting without a licence in Newham carries civil penalties of up to £40,000. Tenants can claim back up to 24 months of rent through a Rent Repayment Order. And Newham's enforcement record is extensive — they are not a borough that waits for complaints before acting.
