EICR and Tenancy Deposit Compliance in Northern Ireland

Two Separate Obligations, One Enforcement Visit

An Electrical Installation Condition Report (EICR) and tenancy deposit protection are separate legal duties for landlords in Northern Ireland. One concerns property safety, the other concerns financial protection for tenants. But in practice, they are enforced by the same teams — local council Environmental Health officers — and a failure on one often triggers scrutiny of the other.

Since 1 December 2025, all private tenancies in Northern Ireland must have a valid EICR, brought in under the phased implementation of the Private Tenancies Act (NI) 2022. The deposit protection obligations — protect within 28 days, serve prescribed information within 35 days, cap at one month's rent — have been in force since 1 April 2023 under the same Act.

When a council officer investigates a tenant complaint about electrical safety, they routinely check the full PTA 2022 compliance picture. If the EICR is missing and the deposit is unprotected, the landlord faces enforcement action on both fronts.

How They Overlap

The connection is not legal — the EICR does not affect deposit protection, and deposit protection does not affect the EICR. The overlap is operational:

Shared enforcement machinery. Council Environmental Health teams handle both. A single complaint can open a file that covers safety certificates, deposit protection, landlord registration, and the Tenancy Information Notice. Landlords who are compliant on deposit protection but missing an EICR (or vice versa) still face enforcement action on the gap.

Shared documentation burden. At the start of a tenancy, a landlord must produce the EICR for the property, protect the deposit, serve prescribed information, serve a TIN, and provide a rent book. Treating these as separate workstreams increases the chance of missing one. A compliance checklist that tracks all PTA 2022 duties together reduces that risk.

Deposit dispute leverage. In ADR proceedings, adjudicators focus on the deposit claim itself — was the deduction justified, was the evidence sufficient. But tenants who discover broader non-compliance (no EICR, no prescribed information, late deposit protection) often use that leverage in negotiations before ADR. A landlord who is non-compliant on safety standards is in a weak position to argue over a £200 cleaning deduction.

What the EICR Requires

A qualified electrician inspects the property's fixed electrical installation (wiring, sockets, consumer unit, fixed appliances) and grades it satisfactory or unsatisfactory. The EICR is valid for five years or the period specified by the electrician, whichever is shorter.

Landlords must obtain an EICR before granting a new tenancy and must renew it before it expires during an ongoing tenancy. The report must be made available to the tenant upon request.

An unsatisfactory EICR requires remedial work before the installation is brought to standard. Letting a property with an unsatisfactory EICR — or without an EICR at all — is a breach of the PTA 2022 obligations.

The Compliance Checklist Approach

Rather than managing deposit protection, EICR, gas safety, and landlord registration as four separate checklists, landlords serving the Northern Ireland market benefit from a unified compliance timeline. The key dates are:

  • Before letting: Landlord registration, valid EICR, valid gas safety certificate (if applicable), Energy Performance Certificate
  • Day 0 (deposit received): 28-day deposit protection clock and 35-day prescribed information clock start
  • Within 28 days of receipt: Protect the deposit and obtain the Deposit Protection Certificate
  • Within 28 days of tenancy start: Serve the TIN
  • Within 35 days: Prescribed information (with scheme leaflet) served and acknowledged
  • Ongoing: EICR renewed before expiry, deposit scheme record updated for any tenancy variation

The Tenancy Deposits in Northern Ireland guide integrates deposit protection into the wider PTA 2022 compliance timeline, so landlords can track every deadline — deposit, EICR, TIN, registration — from a single reference document.
