First-Time Landlord in Wales — Rent Smart Wales Registration Guide

You Are Probably Here Because Something Just Happened

Most first-time landlords in Wales do not plan to become landlords. They inherit a property with a sitting tenant. They relocate for work and cannot sell their old house. They take in a family member's property during a divorce. The rental comes before the research.

Whatever brought you here, the legal position is the same: you own a residential property in Wales that is or will be rented out, and you must register with Rent Smart Wales before marketing or managing it. No exceptions for portfolio size, intention, or the number of years you have owned the property.

The Three Things You Must Do

1. Register as a landlord (£60 online)

This is mandatory for every landlord in Wales, regardless of whether you self-manage or use an agent. Registration records your identity and links your property to the Rent Smart Wales register. It takes 15–30 minutes online at rentsmart.gov.wales.

2. Decide how the property will be managed

You have two choices:

  • Self-manage: You handle viewings, tenant queries, rent collection, repairs and notices yourself. This requires a Landlord Licence (£254 online) and approved training (£35 online)
  • Appoint a licensed agent: The agent handles all management tasks under their own RSW licence. You pay the agent's fee (typically 10–15% of rent plus VAT) but avoid the licensing cost and training

Most accidental landlords with a single property start by self-managing and move to an agent later if the workload grows. Either route is fine — the critical point is that the correct licence is in place before any management activity begins.

3. Meet wider Welsh compliance requirements

Registration and licensing are the gateway obligations, but Welsh landlord law extends further:

  • Provide a written statement of the standard occupation contract within 14 days of the occupation date
  • Protect any deposit in a government-approved scheme (DPS, MyDeposits or TDS) within 30 days
  • Ensure the property meets fitness for human habitation standards — interlinked smoke alarms on every storey, carbon monoxide detectors where applicable, a valid EICR (every 5 years), and an annual gas safety certificate

Inherited Properties and Executors

If you administer an estate with a tenanted property, a court-appointed executor or personal representative may complete the registration on the estate's behalf. When an already-tenanted property is legally transferred to a new landlord, the 28-day update period runs from the date of assignment or completion.

During probate, the executor or personal representative is the person Rent Smart Wales permits to act for the deceased landlord's estate. The beneficiary's registration duty depends on when the legal landlord position transfers.

Agents cannot register on your behalf. Even if you immediately appoint an agent to manage the property, the registration must be completed personally by the executor or new owner.

Accidental Landlords: The Common Mistakes

Assuming English rules apply. Welsh housing law is fully devolved. Assured shorthold tenancies do not exist in Wales — they were replaced by standard occupation contracts under the Renting Homes (Wales) Act 2016. English landlord forums, English letting agent templates and English legal guides can lead you seriously wrong.

Registering but not getting licensed. Registration confirms ownership. If you self-manage — even just collecting rent from one tenant — you also need a Landlord Licence. Operating without one means a Section 173 notice is invalid, and a contract-holder can seek a rent repayment order for a licensing offence.

Delaying because you plan to sell. The registration obligation exists from the moment the property is let or marketed. Selling plans do not create an exemption. If the property has a tenant today, you need to be registered today.

Ignoring the five-year renewal. Registration and licensing each last five years. Set reminders for both expiry dates now — years before they matter — because the penalties for lapsing are immediate.

What It Costs

Item Online Fee
Landlord Registration £60
Landlord Training £35
Landlord Licence (if self-managing) £254
Total (self-managing) £349
Total (using a licensed agent) £60

These fees cover five years. For a self-managing landlord, that works out to about £70 per year.
